14759M M A M M M M M 0 M M ORDINANCE NO. 14,759 L M M AN ORDINANCE WAIVING COMPETITIVE BIDDING, APPROPRIATING $100,000.00 FROM THE UNEXPENDED BALANCE OF THE GENERAL FUND FOR EMERGENCY REPAIRS AT 20TH AND HIGH STREETS, AND DECLARING IT AN EMERGENCY. M M WHEREAS, an exceptional situation exists and competitive bidding should be waived so that the City may immediately negotiate a contract for emergency repairs to 20th and High Streets for repairing damages to a bridge, roadway, and retaining wall leading up to the bridge; and WHEREAS, Nabholz Construction Company is currently under contract with the City to construct the drainage project on the Leawood Branch and Sunnymeade and is familiar with the City construction procedures and specifications and is well qualified to undertake the necessary emergency works; and WHEREAS, the damage to this portion of the street is such that the bridge and abutting roadway have been closed to all traffic and the hydraulic capacity of the abutting channel (Swagerty Branch) is severely restricted; and WHEREAS, High Street is an important minor arterial serving the central area of Little Rock; and WHEREAS, it is in the public interest to repair the channel, minor arterial street and damaged bridge immediately. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock Board of Directors hereby declares that an exceptional situation exists and competitive bidding is hereby waived. SECTION 2. $100,000.00 is hereby appropriated from the unexpended balance of the General Fund for these emergency repairs at 20th and High Streets. The City Manager is hereby authorized to award a contract to Nabholz Construction Company for a total price not to exceed $100,000.00 for these repairs. 115 0-7 "r-3 SECTION 3. Declaring an Emergency. It is hereby found and determined that there is an immediate and urgent need for the repairs at 20th and High Streets. High Street is an important minor arterial that serves the central area of Little Rock and has been closed to all traffic because of the extensive damage. In addition, the hydraulic capacity of the abutting channel is restricted and constitutes a danger to the public health, safety and welfare. Conditions exist such that competitive bidding must be waived and repairs must be started immediately for the preservation and advancement of the public peace, health, safety and welfare. Therefore, an emergency is hereby declared to exist and this ordinance being necessary for the preservation and advancement of the public peace, health and safety, shall be in full force and effect from and after its passage.
