AN ORDINANCE APPROVING AND ADOPTING THE
RECOMMENDATION OF THE LITTLE ROCK PLANNING
COMMISSION FOR THE ESTABLISHMENT OF A PARKS,
PLAYGROUND, AND RECREATIONAL AREAS PLAN FOR
THE LITTLE ROCK PLANNING AREA.
WHEREAS, the Little Rock Planning Commission has developed,
reviewed, and, after public discussion, has recommended approval
and adoption of the "Park System Master Plan 1983 ",

Section 3. The parks, playgrounds, and recreational areas
shown on the Plan presently serve, or shall be planned to serve
their functions according to the Planning Concepts and Park
System Standards listed in the Plan.

(a) Any subdivider of land within the planning area of the
Little Rock Planning Commission, who proposes to make or has made
a subdivision of said land, shall conform to this Plan by
indicating on any plats or drawings submitted to the Commission
for its consideration any and all proposed park facilities which
are located within the property, and shall plat the park lands to
the dimensions and in the location determined by the Commission.
Such park lands shall be reserved for acquisition by the City of
Little Rock. Such acquisition must be made within twelve (12)
months from the date the subdivider's plat is presented to the
Little Rock Planning Commission. Further, acquisition shall be
deemed as having been made when either an option to purchase is
executed or litigation to condemn is filed by the City of Little
Rock. No subdivider shall be denied the privilege of having a
plat approved solely by reason of the issue of reserved park
lands unless the City of Little Rock determines and advises the
subdivider, within sixty (60) days from the date his plat is
presented to the Little Rock Planning Commission, that public
funds for the acquisition of such park lands will be available
within twelve (12) months from the date the plat is presented.
(b) Whenever the Little Rock Planning Commission is
presented with a request for consideration of a plat involving
the expansion of any mapped existing facility, or a proposed
facility, the Commission shall require, in conjunction with the
approval of the plat, reservation of the park land as
hereinbefore stipulated.
(c) No building permit shall be issued for any structure
on any lot or parcel on which any proposed park lands are
indicated unless it has first been determined that the proposed
structure would not lie within the proposed bounds of the park
lands, or unless otherwise authorized under the provisions of
said Act 186, Ark. Acts of 1957, as amended. Nothing herein
contained, however, shall be construed to deny a permit for the
use of such lot or parcel for purposes not involving the
construction or relocation of buildings.

(d) This Plan shall be duly considered prior to action on
any matter related thereto which comes before the Little Rock
Planning Commission, this Board, or any of the departments,
agencies, boards or commissions of this City.
Section 5. A copy of this ordinance, together with the
maps and charts referred to herein, shall be filed in the office
of the Recorder of Pulaski County as required by Act 186, Ark.
Acts of 1957, as amended.
Section 6. If any section, clause, paragraph, provision,
or portion of this ordinance and plan shall be held invalid or
unconstitutional by any court of competent jurisdiction, such
holding shall not affect any other section, clause, paragraph,
provision, or portion of these rules and regulations.
Section 7. The following ordinances of the City of Little
Rock are hereby repealed: No. 11,354, 11,388, 11,426, 11,658,
11,730, 11,859, 12,097, 12,213 12,545, 12,666, 13,359, 14,036,
14,333 and 14,406.
