ORDINANCE NO. 14,302 AN ORDINANCE ANNEXING TO THE CITY OF LITTLE ROCK, ARKANSAS, CERTAIN LANDS SITUATED IN PULASKI COUNTY, ARKANSAS, WHICH ARE CONTIGUOUS AND ADJACENT TO THE CITY OF LITTLE ROCK; AUTHORIZING AND DIRECTING THE SUBMISSION OF THE QUESTION OF SAID ANNEXATION TO THE QUALIFIED ELECTORS OF THE CITY OF LITTLE ROCK AND THE AREA TO BE ANNEXED AT THE GENERAL ELECTION TO BE HELD NOVEMBER 2, 1982; DIRECTING THE CITY OFFICIALS TO TAKE ANY AND ALL OTHER ACTION NECESSARY TO ACCOMPLISH SAID ANNEXATION: PROVIDING A SCHEDULE OF SERVICES THAT WILL BE EXTENDED TO THE ANNEXED AREA WITHIN THREE (3) YEARS AFTER THE DATE THE ANNEXATION BECOMES FINAL; DECLARING AN EMERGENCY: AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That.certain real property hereinafter described which is located in Pulaski County, Arkansas, and adjacent and contiguous to the present corporate limits of the City of Little Rock, Arkansas, all of which lands are either platted and held for sale or use as municipals lots; or whether platted or not are held to be sold as suburban property; or furnish the abode for a densely settled community; or represent the actual growth of the City of Little Rock beyond its legal boundary; or are needed for purpose of extension into the area of all the proper municipal services of the City of Little Rock such as the extension of needed police regulation and protection; or they are valuable by reason of their adaptability for prospective municipal purposes and should be and-are hereby annexed to the present City of Little Rock for the best interest of the area to be annexed and of the City of Little Rock thereby providing for and protecting the public peace, health, and safety. AND Tract "O ": A tract of land lying in Sections 18, 17, 16, 21, 22 and fractional Section 15, T -2 -N, R -13 -W, in Pulaski County, Arkansas, being more particularly described as follows: Beginning at the intersection of the East and West centerline of the N 1/2 of Section 18, with the centerline of the Chicago and Rock Island Railroad; thence Easterly along the said East and West centerline approximately 3,800 feet to its intersection with the said Southerly railroad right -of -way line; thence Southeasterly along said railroad right -of -way line to the East line of Section 18; thence Southerly along the said section line to the East Quarter corner of Section 18; thence Easterly along the centerline of Section 17 to the Southeast corner of the SW 1/4, NW 1/4 of Section 17; thence Northerly along the East line of the SW 1/4, NW 1/4, approximately 700 feet to the said Southerly railroad right -of -way line; thence Southeasterly along the said railroad right -of -way line for approximately 11,200 feet to the East line of the W 1/2, W 1/2 of said Section 22; thence Northerly along the East line of the said W 1/2, W 1/2 of Section 22 to a point on the centerline of the Little Maumelle River, said point being on the existing City limits line of the City of Little Rock; thence Northwesterly along and binding on the meanders of the Little Maumelle River for a distance of approximately 17,800 feet to the centerline of the Pinnacle Valley Road; thence Southwesterly along the road centerline to its intersection with the centerline of the Chicago, Rock Island and Pacific Railroad; thence Northeasterly along said railroad centerline to the point of beginning; The area to be annexed to include all adjacent streets and railroad rights -of -way; The area described to be annexed contains 188.3 acres, more or less. SECTION 2. The question of the annexation of the real property described in Section 1 hereof to the City of Little Rock is hereby submitted to the qualified electors of the 11 City of Little Rock and of the area so described at the 384 General Election which will be held on November 2, 1982. SECTION 3. The City of Little Rock proposes and commits itself to the extension of public services now available to the City of Little Rock into the area to be annexed by this Ordinance within three (3) years from the date the annexation becomes final in keeping with the following schedule: A. Animal Control Services B. Fire Fighting and Fire Prevention C. Police Protection and Crime Prevention D. Parks and Recreation Services E. Street Maintenance F. Garbage Collection and Disposal Services G. Storm Drainage Maintenance H. Traffic Control, Equipment and Services I. Planning and Development Services J. Building Safety Services SECTION 4. In the event, a majority of qualified electors voting in the election provided for in Section 2 hereof vote for the annexation to the City of Little Rock of lands herein described, the City Manager and all other responsible City Officials of the City of Little Rock are directed to take any and all appropriate action necessary and required to complete the annexation of said lands, or any part thereof, to the City of Little Rock in compliance with the provisions of the laws of the State of Arkansas. SECTION 5. This Ordinance is enacted pursuant to and in keeping with the provisions of Act No. 298, Acts of Arkansas of 1971, as amended by Act No. 309 and Act No. 904, Acts of Arkansas 1975. 12 SECTION 6. In the event, that any of the annexed 385 tracts are found by a court of competent jurisdiction not to meet the requirements of Arkansas Statutes, such finding will not affect the validity of the annexation of the remainder of the annexed tracts. All such tracts shall continue to be separately considered. SECTION 7. The annexation of the lands described by this Ordinance to the City of Little Rock, Arkansas, is found to be vital and critical to the public peace, health, and safety of the lands to be annexed and the City of Little Rock, therefore, an emergency is declared to exist and this Ordinance shall be in full force from and after its passage.
