14288ORDINANCE NO. 14,288 J AN ORDINANCE AMENDING THE TEXT OF CHAPTER 43, SECTION 2 -102 -B DEFINING CERTAIN TYPES OF LAND USES; CREATING SECTION 4 -102.1 ESTABLISHING A SPECIAL USE PERMIT PROCESS IN THE CODE OF ORDINANCES; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That Chapter 43, Section 2 -102 -B be amended in the following respects: A. Paragraph 50 - Day Care Center: Any facility conducted under public or private auspices on a profit or nonprofit basis providing a planned child development program or giving direct care and protection for children which requires licensing by the State of Arkansas, except that facility which is defined herein in Paragraph 50A as a licensed day care family home. B. Paragraph 50A is hereby inserted to read as follows: Day Care Family Home: Any facility which provides family like child care in the care giver's own family residence in accordance with provisions of licensing procedures established by the State of Arkansas and which serves no more than ten (10) children including the care giver's own children. Said facility must obtain a Special Use Permit in all zoning districts where day care centers are not allowed by right. SECTION 2. That Chapter 43, Section 4 -102.1 is hereby inserted into the Little Rock Code of Ordinances as follows: SECTION 4 -102.1 SPECIAL USE PERMITS A. GENERAL PURPOSE The purpose of this section is to provide a method of control over certain types of land uses which while not requiring the full review process of the conditional use permits, do require some review procedure which allows for determination of their appropriateness within the neighborhood for which they are proposed and for public comment. B. APPLICATION PROCEDURE The property owner, or his authorized agent, shall apply for a Special Use Permit under the guidelines provided by the Office of Comprehensive Planning. A public hearing on the Special Use Permit will be held by the Planning Commission, and an ordinance granting the Special Use Permit will be presented to the Little Rock Board of Directors upon a recommendation for approval from the Planning Commission. No activity which requires aaid approval shall be conducted prior to passage of the necessary ordinance. C. USES REQUIRING SPECIAL USE PERMITS Uses which are determined to require Special Use Permits will be designated in the Definition of Uses Section of this Ordinance, Section 2- 102 -B, when such uses are included within this ordinance. D. TRANSFER OF PERMITS Special Use Permits shall not be transferable in any manner. Permits cannot be passed owner to owner, location to location or use to use. SECTION 3.
