AN ORDINANCE AMENDING VARIOUS PROVISIONS
OF CHAPTER 12 OF THE CODE OF ORDINANCES
OF THE CITY OF LITTLE ROCK, ARKANSAS,
SAID CHAPTER DEALING WITH THE ELECTRICAL
CODE OF THE CITY; FOR THE PURPOSE OF
REDESIGNATING THE POWERS AND DUTIES OF
THE BOARD OF ELECTRICAL EXAMINERS AND
APPEALS; AND FOR OTHER PURPOSES.,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1. The following sections and subsections of
Chapter 12 of the Code of Ordinances are amended as follows:
I
SECTION 12 -2 - Subparagraph (r) is amended to read as
follows:
(r) SECTION 110 -3B of the 1978 National Electrical
Mi Code is hereby amended to read as follows:

v Listed or labeled equipment shall be used or
u installed in accordance with any instruction
0 included in the listing or labeling.
Exception No. 1
Where the marking on air conditioning equipment
specifies fuses, such equipment shall be permitted
to be protected by circuit breakers instead of
fuses; provided the circuit breaker installation
complies with Parts C and F of Article 440 of the
National Electrical Code.
SECTION 12 -3 - Inspectors, Permits and Fees -
Subparagraph (e) is amended to read:
(e) Fees
Fees are set forth in separate Ordinance
establishing permit fee schedules for Building,
Electrical, Plumbing and related work performed in
the City of Little Rock.
Subparagraph (f) is deleted in its entirety.
Subparagraph (g) "Plural Fees" renumber to read:
1. "Plural Fees."
Subparagraph (h) "Rough Inspections" redesignate
as (f) "Rough Inspections."
Subparagraph (i) "Final Inspections" redesignate
as (g) "Final Inspections."
Subparagraph (j) "Liability" redesignate as (h)
"Liability."

SECTION 12 -6 is amended to read: Board of Electrical
Code Appeals - Composition: Duties in General.
SECTION 12 -6 Subparagraph (a) is amended to read:
(a) There is hereby established a Board of six (6)
members to be known as the Board of Electrical
Code Appeals. Such Board shall be composed of
personnel having the following qualifications::
1. Two Master Electricians, licensed by the
State of Arkansas who are not principals in
any electrical or general contracting firm.
2. One Journeyman licensed by the State of
Arkansas.
3. Two professional electrical engineers as
licensed by State law who are consulting
engineers that do not represent any vendor or
manufacturer.
4. One member shall be an electrical contractor,
duly licensed to do business in the City of
Little Rock.
Subparagraph (b) is amended to read:
(b) The Board shall have the power and it shall be the
duty of the Board to hear and act on appeals of
decisions of the Chief Electrical Inspector, and
to review and make recommendations on all proposed
changes to Chapter 12 of the Code of Ordinances of
the City of Little Rock.
SECTION 12 -7 Subparagraph (a) (1) is amended to read:
(1) Two members for one -year terms,
SECTION 12 -8 is amended to read: Same - Quorum;
Meetings; Reports; Removal of members; Requisitions.
SECTION 12 -8 subparagraph (a) is amended to read:
(a) A majority of the Board shall constitute a quorum
to transact the business thereof. The Board shall
hold special meetings upon call of the Chairman
whenever the business of the Board requires it.
The books, papers and records of the Board shall
at all times be open and subject to inspection.
The Chairman shall file an annual report through
channels to the City Manager detailing the actions
of the Board for the preceding year.
Subparagraph (b) is amended to read:
(b) The Board of Electrical Code Appeals shall adopt
such rules and regulations for the conduct of the
business of the Board as may be necessary, not in
conflict with the laws of the State of Arkansas,
the provisions of this Article or any Ordinance
which may hereafter be passed and shall have the
power to change and amend the same subject to this
limitation. A copy of any rules and regulations
adopted before becoming effective shall be
approved by the City Manager and filed with the
City Clerk.
SECTION 12 -9 is amended to read:
SECTION 12 -9 - Appeals; Time Limit
Subparagraph (a) is amended to read:

(a) Whenever the Chief Electrical Inspector shall
reject or refuse to approve the mode or manner of
electrical construction proposed to be followed or
materials to be used in the erection or alteration
of a building or structure or when it is claimed
that the provisions of this Code do not apply or
that an equally good or more desirable form of
construction can be employed in any specific case
or when it is claimed that the true intent and
meaning of this Code or any of the regulations
thereunder have been misconstrued or wrongly
interpreted, the owner of such building,
structure, or premises, his duly authorized agent,
assistant, general contractor, contractor,
subcontractor, architect, engineer, or other
aggrieved party having direct interest or may be
directly affected by the interpretation and
application of the Code may appeal from the
decision of the Chief Electrical Inspector to the
Board of Electrical Code Appeals. Notice of
appeal shall be in writing and filed within thirty
(30) days after the decision is rendered by the
Chief Electrical Inspector.
SECTION 12 -10 is amended to read:
SECTION 12 -10 - Decision of the Board of Electrical
Code Appeals - Variations and Modifications
Subparagraph (a) is amended to read:
(a) The Board of Electrical Code Appeals when so
appealed to and after a hearing may vary the
application of any provision of this Code to any
particular case when in its opinion the
enforcement thereof would do manifest injustice
and would be contrary to the spirit of this Code
or public interest, or when in its opinion the
interpretation of the Chief Electrical Inspector
should be modified or reversed.
Subparagraph (b) is amended to read:
(b) A decision of the Board of Electrical Code Appeals
to vary the application of any provision of this
Code or to modify any order of the Chief
Electrical Inspector shall specify in what manner
such variation of modification is made, the
conditions upon which it is made and the reason
therefor.
SECTION 12 -11 is amended to read:
SECTION 12 -11 - Same - Effect of Generally
Subparagraph (a) is amended to read:
(a) Every decision of the Board of Electrical Code
Appeals shall be final, subject to such remedy as
any aggrieved party might have at law or in
equity. Decisions shall be in writing and shall
indicate the vote thereon. Every decision shall
be promptly filed in the Office of the Chief
Electrical Inspector and shall be open to public
inspection. A certified copy shall be sent by
mail or otherwise through the Appellant, and a
copy shall be kept publicly posted in the office
of the Chief Electrical Inspector for two (2)
weeks after filing.

Subparagraph (b) is amended to read: 74
(b) The Board of Electrical Code Appeals shall in
every case reach a decision without unreasonable
or unnecessary delay.
Subparagraph (c) is amended to read:
(c) If a decision of the Board of Electrical Code
Appeals reverses or modifies a refusal order or
disallowance of the Chief Electrical Inspector or
varies the application of any provision of the
Code, the Chief Electrical Inspector shall
immediately take action in accordance with such
decision.
SECTION 12 -12 is amended to read:
SECTION 12 -12 - Examination and License Required;
Penalty for Violation
Subparagraph (a) is amended to read:
(a) No person, member and /or employee of a firm or
corporation shall engage in the electrical
business of installing, altering or repairing any
electricial wiring, fixtures, devices or equipment
in the City; unless such persons, members and /or
employees of a firm or corporation have been duly
examined and have been issued a license to engage
in such business; such license to have been issued
by the Chief Electrical Inspector. Permits to
perform electrical work shall be issued by the
Chief Electrical Inspector only to such persons,
members and /or employees of a firm or corporation
holding such license.
SECTION 12 -13 - Subparagraph (a) is amended to read:
(a) Every person, member and /or employee of a
partnership, firm or corporation desiring to
engage in the electrical business as heretofore
defined shall before engaging in such business
successfully pass an examination prepared,
conducted and held by the Chief Electrical
Inspector. All applicants desiring to take such
examination shall apply in writing to the Chief
Electrical Inspector and shall file such
information as may be required by him to determine
the qualifications of said applicant. The
information available from the application and
subsequent investigation shall be considered by
the Chief Electrical Inspector. Those applicants
.meeting the requirements as established shall be
given the privilege to take the examination. The
applicant shall pay to the City Collector an
examination fee in the sum as hereinafter set
forth and shall exhibit a receipt for such fee to
the Chief Electrical Inspector before he shall be
allowed to take such examination. The Chief
Electrical Inspector shall fix the time and place
for the examination of applicants, and if he shall
find upon examination that any applicant has a
reasonable knowledge of the natural and practical
laws and functions of electricity, the safe,
correct, approved manner of installing devices,
apparatus and instrumentalities for electrical
light, heat, power and signaling purposes and the
Ordinances of the City of Little Rock which govern

the installation of electrical devices, apparatus
and instrumentalities, then he shall issue to such
person the license for which applied, which
license shall indicate thereon his qualification
and the fact that he has successfully completed
and passed the examination given for his
particular type of electrical work. All such
licenses shall expire on the 31st day of December
of the year indicated on the license. All duly
licensed persons who apply for such license within
thirty -one (31) days after the expiration day
shall pay the fee hereinafter mentioned for
renewal.
Subparagraph (b) is amended to read:
(b) If such renewal is not applied for on or before
the 21st day of January succeeding the period of
the license, a penalty of $5.00 will be assessed
in addition to the regular renewal fee. If the
license is not renewed by June 30, the applicant
shall be reexamined and shall be required to pay
the examination fees for such examination as
hereinafter prescribed.
Subparagraph (c) is amended to read:
(c) The Chief Electrical Inspector shall have the
power to investigate and evaluate the electrical
courses, apprenticeship training programs and /or
other experience that may provide sufficient
training and experience to comply with the scope
of SECTION 12 -14 of this Code. Such evaluation
shall be subject to review by the Board of
Electrical Code of Appeals if appealed.
SECTION 12 -14 - Classification and Qualifications of
Applicants
Subparagraph E 1 -c is amended to read:
C. He shall have a combination of training and
experience consisting of experience with a
licensed electrical contractor, a licensed air
conditioning electrical contractor and training
through an approved electrical training program to
achieve a level of competency as may be determined
by the Chief Electrical Inspector.
Subparagraph E 3 a. is amended to read:
a. Each individual holding a specialist
refrigeration electrician's license at the
time of the adoption of this Ordinance shall
have the option of retaining their existing
license or qualifying for a supervising air
conditioning electrician or an air
conditioning electrician's license within a
two -year period from the date of this
Ordinance by obtaining additional training
and successfully passing a written
examination as determined by the Chief
Electricial Inspector.
SECTION 12 -14 - Subparagraph G. 1. is amended to read:
G. Electrical Contractor
1. Electrical contractor shall be defined
to include any person, member, and /or
employee of a firm, partnership or
corporation engaged in the business of

g, erecting or repairing or
contracting to install, erect or repair
electric wires or conductors to be used
for the transmission of electric light,
heat or power purposes or to install or
repair moldings, doors, raceways or
conduit for the reception of protection
of such wires or conduits or any
electrical machinery, apparatus or
assistance to be used for electric
light, heat or power or signaling
purposes. Any person, member and /or
employee of a firm, partnership or
corporation engaged in the business of
installing electrical wiring or
equipment of alarm or signal systems or
less than thirty (30) volts shall not be
required to take permits, provide for
inspection and be bonded as required by
this Chapter. They shall be classified
as signal contractors and shall file
with the Chief Electrical Inspector the
same information as the electrical
contractor, except the name of the
principal of the company shall be
recorded in lieu of the master
electrician. The installation, repair
or alteration of wiring or equipment of
thirty (30) volts or more or the
connection of wiring of thirty (30)
volts or more shall be done by
electrical contractor employing a master
electrician. The contractor license fee
for alarm and signal contractor shall be
determined by the licensing ordinance.
Subparagraph G - 2. is amended to read:
2. Any person, member and /or employee of a
firm, partnership, or corporation
desiring to engage in the business of
electrical contractor may apply for and
be issued a license upon satisfying said
Chief Electrical Inspector that he is
either a master electrician or employs a
master electrician as its superintendent
or manager and shall pay a license fee
as provided in the Privilege License
Ordinance of the City of Little Rock.
Subparagraph G - 3. is amended to read:
3. Before any person, firm, partnership or
corporation shall engage in the business
of electrical contracting as herein
defined, the name, residence and place
of business of such person, firm,
partnership or corporation shall be
registered with the Chief Electrical
Inspector. Said registration shall
include the name of the master
electrician managing or supervising the
business of such person, firm,
partnership or corporation as
superintendent or manager and the date
on which such person qualified as a
master electrician under the terms and
provisions of this Article. Every
removal of place of business or change
in the name of the organization or

electrician in charge of the business
shall require immediate notice thereof
to the Secretary of said Board who shall
make the proper changes in the record
heretofore mentioned. Every electrical
contractor shall promptly report to the
chief Electrical Inspector the death,
resignation or discharge of his or its
master electrician, and if another
master electrician is not secured within
three (3) days after the next successing
examination held, therefore, the license
of such contractor shall be suspended
until a new licensed master electrician
is employed.
Subparagraph 12 - 14 Subparagraph H 2 b. is amended to
read:
b. Any person, partnership, firm or corporation
desiring to engage in the business of specialist
electrical refrigeration contractor may apply for
and be issued a license upon satisfying the Chief
Electrical Inspector that he or it has either a
master electrician, a journeyman electrician, a
supervising air conditioning electrician, an air
conditioning electrician, or a specialist
refrigeration electrician as its superintendent or
manager, and shall pay a license fee as provided
in the Privilege License Ordinance of the City of
Little Rock.
SECTION 12 - 16 - License Nontransferable; Revocation;
Unlawful to Operate Without
Subparagraph (a) is amended to read:
(a) No license certificates issued by the City shall
be assignable or transferable. Any license issued
may be suspended or revoked by the City for any
violation of the terms of this Chapter or any
Ordinance governing the installation or inspection
of electric work, or any rules and regulations
promulgated by the City after a hearing.
SECTION 12 - 18 - Fraud in Connection with License
Subparagraph (a) is amended to read:
(a) It shall be unlawful for any person, firm or
corporation licensed under this Article to alter,
transfer, lend or rent his or its license
certificate or use a license not his or its own.
It shall also be unlawful for any person to
falsely represent himself or themselves to be
licensed under this Article or to wrongfully use a
license.
SECTION 12 - 19 Subparagraph (b) is amended to read:
(b) A permit may be issued to a property owner to do
work to his own home provided he has a current
master or journeyman electrician's license
recognized by the City of Little Rock or can
submit sufficient proof that he possesses the
knowledge and experience to such a degree that he
is capable of wiring his own home according to
this Code, and can show proof that he owns the
home, is presently residing or will reside in the

structure after completion. All electrical work ' 78
shall be done by the applicant. Prior to issuing
an electrical permit, the applicant must submit in
writing a statement containing his name, current
address, telephone number and agreement to comply
with the applicable provisions of this Code.
Subparagraph (c) is amended to read:
(c) A fee of $5.00 will be assessed to each applicant
applying for a certification by the Chief
Electrical Inspector.
SECTION 2. This ordinance shall be in full force and effect from
and after its passage and approval.
