82920 RESOLUTION NO. 8,292 A RESOLUTION APPROVING AND ACCEPTING THE DEDICATION OF A PORTION OF FINANCIAL CENTER PARKWAY AND A PORTION OF CHENAL PARKWAY TO THE STREET SYSTEM OF THE CITY OF LITTLE ROCK, ARKANSAS; AND OTHER MATTERS PERTAINING THERETO. WHEREAS, the City of Little Rock, Arkansas (the "City ") entered into an agreement with the Commissioners of the Interstate 630 to Highway 10 Road Improvement District No. 338 of Pulaski County, Arkansas (the "District ") for the purpose of constructing certain road improvements generally described as "Phase I," and more particularly described as beginning at the western most terminus of Financial Center Parkway, thence continuing along Hermitage Road to its intersection with Autumn Road, thence continuing northwesterly from Autumn Road to Bowman Road, thence continuing in a northwesterly direction from Bowman Road to a point near the eastern beginning of Rock Creek Parkway ( "Phase I "); WHEREAS, the District undertook the construction of certain additional road improvements generally described as "Phase II," and more particularly described as beginning near the juncture of Kanis Road and the end of the former Rock Creek Parkway, and continuing northwesterly to State Highway 10 ( "Phase II "); WHEREAS, pursuant to Resolution No. 8114 adopted by the City Board of Directors on March 7, 1989, that portion of Phase I from the western terminus of Financial Center Parkway to Autumn Road was redesignated as an extension of Financial Centre Parkway; WHEREAS, pursuant to Resolution No. 8114, that portion of Phase I beginning at Autumn Road and continuing to its juncture with the former Rock Creek Parkway, all of the former Rock Creek Parkway, and all of Phase II were redesignated as Chenal Parkway; WHEREAS, acquisition of all required rights -of -way and construction of all required improvements of Phase I and Phase II have been completed and the District is prepared to dedicate, and the City is willing to accept the dedication of Phase I and Phase II, subject only to the City's approval and acceptance of Phase I and Phase II as part of the Master Street Plan for the City and subject to the District's acceptance of the Letter Agreement described hereinafter. WHEREAS, the City is desirous of accepting the dedication of Phase I and Phase II by its approval of this Resolution. 151 152 NOW, THEREFORE, the Board of Directors of the City of Little Rock does hereby authorize and approve the following: Section 1. That the City acknowledges that all necessary work, including acquisition of rights -of -way and construction of improvements have been completed and are in compliance with all ordinances, rules and regulations of the City of Little Rock, including the Master Street Plan, as amended, subject only to the performance by the District of the conditions of the Letter Agreement between the City and the District as evidenced by letters dated March 27, 1990, and March 29, 1990, copies of which are attached hereto and collectively designated as Exhibit "A" (the "Letter Agreement "). Section 2. That the City does hereby accept the dedication of the rights -of -way for Phase II as set forth in the District's deed, a copy of which is attached hereto as Exhibit "B," and made a part hereof, in full satisfaction of the District's obligations to the City, and does hereby assume and accept responsibility for the ownership and maintenance of Phase II, and does hereby relieve the District of any and all other obligations related thereto, subject only to such other preexisting agreements and understandings related to the issuance by the District of its $8,270,000 Construction Bonds, dated June 1, 1989, and the Letter Agreement. Section 3. That the City does hereby assume and accept responsibility for the ownership and maintenance of Phase I, and does hereby relieve the District of any and all other obligations related thereto, subject only to such other preexisting agreements and understandings related to the issuance by the District of its $8,270,000 Construction Bonds, dated June 1, 1989, and the Letter Agreement. Section 4. That in order to provide for the continuing health and safety of the inhabitants of the City of Little Rock, it is necessary and appropriate for the City to assume immediate responsibility for the ownership and maintenance of Phase I and Phase II, and therefore, an emergency is declared to exist, and this Resolution shall be in full and effect from and after the date of its approval. The City is in agreement with your recommendation to make acceptance subject to completion of an agreed "punch list" by July 30, 1990. We ask that the following be a part of that acceptance procedure: 1. The "punch list" in your March 27, 1990, letter is in agreement with the City's inspection records, but we feel that the value of the work to be done should be increased to $50,000.00, including engineering, to allow for contingency costs in some items. 2. A bond is not acceptable for the performance guarantee on the construction punch list items. A letter of credit on the City's form, or a cashier's check is acceptable. 3. The rights-of -way for all of Phase II must be dedicated to the City by recorded documents acceptable to the City before the road is accepted and officially opened to traffic. 4. The one -year warranty will be considered as beginning on completion of the construction punch list items described in your March 27, 1990 letter. The public is confused because of the signage, barricades, ect. and the limited use of the road. The signs are in place. The striping has been completed. There are a few items to complete, some of which need to wait until dry and warm weather and others that were not part of original plans. The overlays, extension and repair of paved ditch etc. should wait. There is one inlet and cross drain that was not on original plans that will be added. It obviously is not critical. Below is a list of items remaining on the punch list for Phase TI with our estimate of cost. All remianing items should be complete no later than July 30, 1990. No items remain on Phase I, 1. Remove SB -2 behind curbs $ 21000.00 2. Sweep gutters 21500.00 3. Clean out pipe filled with SB -2 - Sta. 106 +50 3,000.00 4. Install underdrain along left shoulder from Sta. 90 +00 for 200.250 ft, up hill. Deferred to see if water seepage has been corrected. If so, not necessary.
