6963RESOLUTION NO. 6,963 A RESOLUTION AUTHORIZING THE CITY ATTORNEY'S OFFICE TO FILE THE NECESSARY CONDEMNATION SUITS TO ACQUIRE LANDS ON THE EAST BANK OF ROCK CREEK BETWEEN BOYLE AND KANIS PARKS. WHEREAS, the City of Little Rock has experienced chronic flooding problems in recent years, and WHEREAS, City Board Resolution No. 6,786 adopted April 20, 1982 has declared drainage to be one of its major priorities, and WHEREAS, City Board Resolution No. 6,949 adopted March 1, 1983 endorses U. S. Corps of Engineers Plan VII with acquisition of the Fourche Bottoms, and further commits the City to provide for 75 percent of the non - federal share of the cost of the project, and WHEREAS, the Water Works has sought to acquire floodlands between Boyle Park and West Markham Street for a major trunk line and has agreed to commit $5,000 toward a joint City /Water Works floodway acquisition program, and WHEREAS, a substantial portion of the Rock Creek Floodway has already been acquired for drainage purposes, and WHEREAS, substantial development interest is becoming apparent elsewhere along Rock Creek adjacent to the floodway, and WHEREAS, negotiations with several of the property owners have failed, and WHEREAS, at its March 15th meeting, the Planning Commission deferred for thirty (30) days a project entitled Woodall's Flea Market, located within and adjacent to the Rock Creek Floodway at South University pending a determination of whether or not the property should be acquired by the public for drainage purposes. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK. SECTION 1. The Board of Directors of the City of Little Rock has determined that the public health, safety and general welfare dictate that crucial floodway property be acquired by the public for drainage purposes. 3�9 SECTION 2. The Board of Directors of the City of Little Rock hereby authorizes the City Attorney to file necessary condemnation suits to acquire lands on the East Bank of Rock Creek between Boyle and Kanis Parks as shown on Attachment A. SECTION 3. The Board of Directors of the City of Little Rock encourages City staff to enter into negotiations with property owners to acquire other floodway property along Rock Creek between University Avenue and West Markham which is needed for drainage purposes. SECTION 4. This Resolution shall be in full force and effect from and after its adoption.
