6943RESOLUTION NO. 6,943 A RESOLUTION EXPRESSING THE OPPOSITION OF THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK TO HOUSE BILL 505 IN THE 74th GENERAL ASSEMBLY OF THE STATE OF ARKANSAS. BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: 295 WHEREAS, House Bill S05 pending in the 74th General Assembly of the State of Arkansas would prescribe and limit the authority of counties and cities to prohibit or restrict the permanent install- ation of manufactured homes on lots zoned for single family dwellings;' and, WHEREAS, the Board of Directors of the City of Little Rock deems such proposal to be adverse to the interest of local governments in regulating the use of property within their jurisdictions for the benefit of their residents, particularly in protecting property values in their localities, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The Board of Directors of the City of Little Rock, Arkansas, hereby states its opposition to the passage of House Bill SOS. Section 2. The City Manager is hereby directed to transmit a certified copy of this Resolution to the Speaker of the House of Respresentatives, the President of the Senate and each member of the Pulaski County delegation to the 74th General Assembly of the State of Arkansas. Wood, Stephens, McKissack For An Act To Be Entitled 1 "AN ACT TO PRESCRIBE AND LIMIT THE AUTHORITY OF COUNTIES 2 AND CITIES TO PROHIBIT OR RESTRICT THE PERMANENT INSTALLATION 3 OF MANUFACTURED HOMES ON LOTS ZONED FOR SINGLE FAMILY DWELLINGS; 4 AND FOR OTHER PURPOSES." 5 6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 7 8 SECTION 1. This Act shall be known and may be cited as the "Manufactured 9 Home Land Use Act ". 10 11 SECTION 2. It is hereby found and determined by the General Assembly 12 that there is an urgent need for affordable single family housing in Arkansas 13 and that manufactured housing can fill this urgent need and give residents 14 of this State an opportunity to own and live in decent, safe and affordable 15 permanent housing; that in many areas of the State, local zoning ordinances 16 prohibit or severely restrict the permanent installation of manufactured 17 homes on lots zoned for single family dwellings; that such unreasonably 18 restrictive zoning ordinances serve to deprive residents of the State of the 19 opportunity of acquiring and owning affordable single family housing; and 20 that it is the purpose and intent of this Act to remove the authority of 21 counties and cities to impose prohibitive or unreasonably restrictive 22 conditions on the permanent installation of manufactured homes on lots 23 zoned for single family dwellings. 24 25 SECTION 3. Counties, cities and towns in the State shall not 26 prohibit the permanent installation of manufactured homes 27 built and certified under the National Manufactured Housing Construction 28 and Safety Standards Act of 1974 (42 U.S.C. Section 5401 et seq.) and 29 regulated by the Arkansas Manufactured Home Commission under authority of 30 Act 533 of 1981, on lots zoned for single family dwellings. I -2- 9 505 H. B. 1 SECTION 4. Any county or city may by ordinance subject any such 2 manufactured home and the lot on which it is placed only to the standards 3 and requirements to which a conventional family residential dwelling on the 4 same lot would be subject, including but not limited to, 5 (a) set back distance, 6 (b) side and rear area, 7 (c) standards for foundations and enclosures, 8 (d) minimum square footage of the dwelling and /or lot size, 9 (e) access and vehicle parking requirements. 10 In addition, any county or city may impose reasonable architectural II and aesthetic requirements regarding roofing and siding materials on 12 manufactured homes permanently installed on lots zoned for single family 13 dwellings but no such county or city shall apply any development, architectural, 14 or aesthetic standards or requirements which will have the effect of totally 15 precluding the permanent installation of manufactured homes on lots zoned 16 for single family dwellings. 17 18 SECTION 5. Any county, city or town may by ordinance designate lots 19 zoned for single family dwellings for manufactured housing as described in 20 this Act when it is determined that such designation is necessary or 21 appropriate. 22 23 SECTION 6. The provisions of this Act shall be applicable only with 24 respect to the permanent placement of manufactured homes certified under the 25 National Manufactured Housing Constuction and Safety Standards Act of 1974 26 and regulated by the Arkansas Manufactured Home Commission under authority 27 of Act 533 of 1981, on lots zoned for single family residential dwellings, 28 and shall not be applicable to nor affect existing laws governing mobile 29 homes or other factory built housing built prior to the National Manufactured 30 Housing Construction and Safety Standards Act and.shall not affect laws 31 governing manufactured housing land use zoning policies not herein described 32 nor other laws regulating manufactured housing and its uses not related to 33 the single family residential zoning policies. However, to the extent that 34 the provisions of this Act are in conflict with any ordinance of any county, 35 city or town, the provisions of this Act shall apply and shall supersede O 36 such ordinances. -2- 9 • • 505 H. B. 1 SECTION 7. All laws and parts of laws in conflict with this Act are 2 hereby repealed. 3 4 SECTION 8.
