7102RESOLUTION NO. 7,102 M M = r A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO ENTER INTO A GRANT-IN-AID - COVENANT WITH THE ARKANSAS HISTORIC PRESER- VATION PROGRAM WITH RESPECT TO THE TERRY MANSION. WHEREAS, the City of Little Rock has received a $65,000 grant through the Arkansas Historic Preservation Program for renovating the Terry Mansion; and WHEREAS, since this grant is federal money from the Federal Jobs Bill, U.S. Department of Interior; and WHEREAS, in order to receive the grant, the City of Little Rock must enter into a covenant. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The City Clerk and the Mayor are hereby authorized and directed to execute the Grant -in -Aid covenant attached hereto as Exhibit A. W. e n a f eld 204 Grant -in -Aid Covenant 205 These covenants made this 7th day of December , 198_, by and between the City of Little Rock, Grantor, and the Arkansas Historic Preservation Program, Grantee; WITNESSETH WHEREAS, one of the purposes of the Arkansas Historic Preservation Program as established by Act 480 of 1975 as amended is to preserve the historic sites and monuments of the State of Arkansas and to encourage the owners of such properties in their preservation and restoration; and WHEREAS, one method to encourage such preservation is to make grants for the improvements of historic properties; and WHEREAS, the Grantors are the leasehold owners or owners in fee simple of improved real property located in Little Rock, which property hereinafter referred to as "premises" is more particularly described as follows: 411 E. 7th; Little Rock, Arkansas; Block 61, Original City of Little Rock. WHEREAS, the Arkansas Historic Preservation Program has deemed that the covenants agreed to in this instrument will aid greatly in preserving and maintaining the premises consistent with the interests and purposes of the Arkansas Historic Preservation Program referred to above; NOW, THEREFORE, in consideration of $65,000 dollars and other good and valuable consideration, the receipt of which is hereby acknowledged, the Grantors and their successors in interest do hereby enter into the following covenants which will run with the land, with the Grantee: PUBLIC BENEFIT Provided, that for a period of 15 years there shall run with the land a covenant, enforceable by the State of Arkansas, requiring the owners and their successors in interest to allow the public to view and visit said property a minimum of 12 days a year, said 12 days being liberally construed as day and /or night and established to allow the public use at a time best suited for the property involved. Further, it is agreed that special tours i 206 may be arranged with advance notice given at times compatible with the owner's use of the property. MAINTENANCE AND ADMINISTRATION Provided, that for a period of 15 years there shall run with the land a covenant, enforceable by the State of Arkansas, requiring the owners and their successors in interest to repair, maintain and administer the premises, so as to preserve the historic and /or architectural integrity of its features, materials, appearance, workmanship and environment. All work must be done in accord with the Secretary of the Interior's Standards for Historic Preservation Projects as they are in effect at the time and any visual or structural alterations will not be made without the prior written permission of the Arkansas Historic Preservation Program. Further, the owners and their successors in interest agree to give the Arkansas Historic Preservation Program the right to inspect the property at all reasonable times in order to ascertain whether or not the covenants are being observed. NOTIFICATION OF TRANSFER OF TITLE Provided, that for a period of 15 years there shall run with the land a covenant, enforceable by the State of Arkansas, requiring the owners and their successors in interest to notify the Arkansas Historic Preservation Program within ninety (90) days if a transfer of title occurs. The covenants he agreed to constitute a binding servitude upon said premises of the Grantors, and to that end Grantors covenant on pehalf of themselves, their agents, personal representatives, heirs and assigns, and all other successors to them in interest, with Grantee, such covenants being deemed to run as a servitude, for a period of 15 years with the land and bind the present owners, their heirs, successors and assigns, future owners and their heirs, successors and assign, and all persons claiming by, through or under them.
