7162RESOLUTION NO. 7,162 RESOLUTION OF THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK APPROVING AND AUTHORIZING EASEMENTS TO BE GRANTED IN FAVOR OF THE LITTLE ROCK - PULASKI DRAINAGE DISTRICT NO. 2. WHEREAS, it is in the best interest of the City of Little Rock, Arkansas, that certain easements be approved and authority be granted for the Mayor of the City of Little Rock to execute certain easements in connection with the proposed Relocation of Roosevelt Road and Fourche Creek Levee, these easements being known as and described as follows: A parcel of right -of -way easement situated in the NW 1/4, NW 1/4 of Section 17, T -1 -N, R -11 -W, City of Little Rock, Pulaski County, Arkansas, being more particularly described as follows: Commencing at a concrete monument at the NW corner of Section 17, T -1 -N, R -11 -W, City of Little Rock, Pulaski County, Arkansas, thence S O1 °26'18" W along the west line of Section 17 for a distance of 356.73 feet to a concrete monument on the south right -of -way line of East Roosevelt Road; thence S O1 027108" W continuing along the west line of Section 17 for a distance of 798.90 feet; thence N 78 034139" E, 914.03 feet to the southerly line of the Little Rock - Pulaski Drainage District No. 2 levee easement; thence S 58 048133" W, along the southerly line of said levee easement 91.86 feet to a Point of Beginning; thence continuing S 58 048133" W, along said southerly easement line 86.01 feet; thence S O1 025106" W along said southerly easement line 25.86 feet; thence N 46 °30'52" E, 102.29 feet to the Point of Beginning; parcel of land containing 0.0215 acres (937 S.F.), more or less. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK: Section 1. The proposed easements described herein are hereby approved and authority is hereby granted to the Mayor to execute these easements in favor of the Little Rock - Pulaski Drainage District No. 2 upon the terms and conditions contained therein and to do all other acts necessary and incidental in connection therewith. ADOPTED: March 20, 1984 ATTEST: CI'YY —% CZECH APPROVED: 0, A-3 M � M me M GRANT OF RIGHT OF WAY EASEMENT B 5 KNOW ALL MEN BY THESE PRESENTS: THAT THE CITY OF LITTLE ROCK (Grantor) pursuant to Resolution No. 7,162 , dated March 20 , 1984, for and in consideration of the benefits accruing to Grantor and the public, does hereby grant, bargain, sell and convey unto the LITTLE ROCK- PULASKI DRAINAGE DISTRICT NO. 2 (Grantee), and unto its successors and assigns forever, a perpetual right, privilege, and easement with the right of ingress and egress a right -of -way easement for levee and drainage district purposes in, over, upon and across the following described parcels of land in Pulaski County, Arkansas: A parcel of right -of -way easement situated in the NW 1/4, NW 1/4 of Section 17, T -1 -N, R -11 -W, City of Little Rock, Pulaski County, Arkansas, being more particularly described as follows: Commencing at a concrete monument at the NW corner of Section 17, T -1 -N, R -11 -W, City of Little Rock, Pulaski County, Arkansas, thence S O1 °26'18" W along the west line'of Section 17 for a distance of 356.73 feet to a concrete monument on the south right -of -way line of East Roosevelt Road; thence S O1 127108" W continuing along the west line of Section 17 for a distance of 798.90 feet; thence N 78 °34'39" E, 914.03 feet to the southerly line of the Little Rock - Pulaski Drainage District No. 2 levee easement; thence S 58 048133" W, along the southerly line of said levee easement 91.86 feet to a Point of Beginning; thence continuing S 58 048133" W, along said southerly easement line 86.01 feet; thence S O1 025106" W along said southerly easement line 25.86 feet; thence N 46 °30'52" E, 102.29 feet to the Point of Beginning; parcel of land containing 0.0215 acres (937 S.F.), more or less. Grantor, at the risk of Grantor, reserves the right to otherwise use the easements for purposes not prohibited herein so long as such use does not conflict or interfere with the Grantee's use of the easements in any way. TO HAVE AND TO HOLD said easements, rights and privileges unto the said Grantee, and unto its successors and assigns forever, for the purposes aforesaid. And said Grantor covenants with said Grantee, its successors and assigns, that Grantor will forever warrant and defend the title to said easements and rights against the claims of all persons whomsoever and that said Grantee, its successors and assigns, shall have at all times the quiet use and enjoyment of said easements and rights.
