A RESOLUTION AUTHORIZING THE MAYOR AND CITY
CLERK TO GRANT RIGHT -OF -WAY EASEMENTS TO THE
LITTLE ROCK SANITARY SEWER COMMITTEE FOR THE
COMPLETION OF THE LITTLE MAUMELLE SEWER
IMPROVEMENT PROJECT.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
Section 1. The Mayor and City Clerk are hereby authorized
to grant right -o£ -way easements to the Little Rock Sanitary Sewer
Committee for the completion of the Little Maumelle Sewer
Improvement Project. The right -o£ -way easement deeds are
attached hereto as Exhibit A.

KNOW ALL MEN BY THESE PRESENTS: 90
THAT the City of Little Rock, GRANTOR, a corporation organ-
ized under and by virtue of the laws of the State of Arkansas, by
its Vice Mayor and City Clerk , duly authorized by proper
resolution of its Board of Directors, for and in consideration of
the sum of Dollars ($ ),
and other valuable consideration paid by the Little Rock Sanitary
Sewer Committee, the receipt of which is hereby acknowledged, do
hereby, subject to prior recorded mortgages and easements, if any,
grant, bargain, sell and convey unto the City of Little Rock,
Arkansas, for the use and benefit of the Little Rock Sanitary
Sewer Committee, GRANTEE, and unto its successors and assigns
forever, the following described easements:
1. A PERMANENT RIGHT, PRIVILEGE AND EASEMENT for the purpose
of permitting the Little Rock Sanitary Sewer Committee and the
Little Rock Wastewater Utility to clear and keep clear the surface
of the right -of -way and to (a) lay, construct, operate, maintain,
repair, replace, reconstruct, test, inspect and add sewer mains
and sewer lines whether one or more, and without the payment of
additional compensation therefor; (b) keeping the easement clear
of all buildings and other improvements of any kind; and (c) hav-
ing the right to free ingress and egress across adjacent lands of
the GRANTOR(S) to the lands hereinafter described. Subject to
prior easement of record and except as hereinafter stated, the
Little Rock Sanitary Sewer Committee shall have the exclusive use
of this right -of -way and easement; and the GRANTOR may hereinafter
use the surface of the easement for any purpose not inconsistent
with the rights hereby conveyed, but may not place a building,
footing, wall, structure, or other improvement upon the right -of-
way except that, after the intitial sewer construction is com-
pleted, the GRANTOR may pave the easement surface and may use it
for driveways, walks or parking areas. The GRANTOR may permit
other utility service to cross this easement at approximately
right angles, but only if such utilities first comply with what-
ever specifications the Little Rock Sanitary Sewer Committee and
the Little Rock Wastewater Utility may designate at the time for
the protection of its own facilities. This permanent easement
shall be upon the following described lands situated in Pulaski
County, Arkansas, to -wit:
A strip of 25 -foot wide permenent sanitary sewer easement
situated in the NE 1/4 of the NW 1/4, Section 22, T -2 -N,
R -13 -W, Pulaski County, Arkansas; the sides of said ease-
ment lying 12.5 feet right and left of the center line
more particularly described as follows:
Commencing at the SE corner of the NE 1/4, NW 1/4, said
Section 22; thence N 880 20' 27" W along the south line
of the NE 1/4, NW 1/4 of Section 22 for a distance of
357.21 feet to a Point of Beginning; thence N 42° 52' 35"
E, 122.72 feet to the southerly right -of -way line of the
Chicago Rock Island and Pacific Railroad; the sides of the
easement to be lengthened or shortened to terminate on the
southerly right -of -way line of the railroad and on the south
line of the NE 1/4, NW 1/4 of Section 22; permanent ease-
ment containing 0.070 acre (3,068 S.F.), more or less.
2. A TEMPORARY RIGHT, PRIVILEGE AND EASEMENT for the purpose
of permitting the Little Rock Sanitary Sewer Committee and the
Little Rock Wastewater Utility to remove all timber and obstruc-
tions therefrom and to make excavations, store excavated materi-
als, tools, supplies and equipment and provide working space.
This temporary easement shall begin when the Little Rock Sanitary
Sewer Committee and the Little Rock Wastewater Utility commence
the initial work on the permanent easement and shall terminate one
year after that date or when that work is completed, whichever is

earlier. This t1borary easement shall be In the following des-
cribed lands situated in Pulaski County, Arkansas, to -wit:
And also a 25 -foot wide strip of temporary construction
easement lying northwesterly of, adjacent to and parallel
with the permanent easement . described above for use dur-
ing initial sewer line construction only.
Upon completion of the initial or any subsequent work by the
Little Rock Sanitary Sewer Committee, the Little Rock Sanitary
Sewer Committee shall backfill and thoroughly compact all excava-
tions to minimize settling and shall level the surface over its
excavations and pipelines, remove all excess excavated materials
and debris and leave the premises in a clean sanitary condition.
If the initial or any subsequent work by the Little Rock Sanitary
Sewer Committee damages any fence, curb or paved surface upon the
rights -of -way, the Little Rock Sanitary Sewer Committee, at its
expense, shall repair or replace the damaged portion with materi-
als of like quality and as nearly as possible to its prior
condition.
The execution of this easement does not give the GRANTOR the
right to connect to or receive service from any sewer or waste-
water facility; the right to make connections and receive service
shall be subject to the rules, regulations, policies or ordinances
in effect at the time of application.
To have and to hold said easements, rights and privileges
unto the GRANTEE, and unto its successors and assigns forever, for
the purposes aforesaid.
And GRANTOR(S) covenants with GRANTEE, its succcessors and
assigns, that subject to prior recorded mortages and easements, if
any, it will forever warrant and defend the title to said ease-
ments and rights against the claims of all persons whomsoever and
that GRANTEE, its successors and assigns, shall have at all times
the quiet use and enjoyment of said easements and rights.

the following described center line:
Commencing at a bolt at the northwest corner of said SE 1/4,
NW 1/4; thence S O1° 23' 34" W along the west line of said
SE 1/4, NW 1/4 for a distance of 365.80 feet to a Point of
Beginning; thence S 390 43' 31" E, 112.14 feet; thence S 110
38' 44" W, 157.18 feet; thence S 590 43' 41" E, 228.99 feet;
thence S 11° 10' 31" E, 484.69 feet; thence S 270 05' 51" E,
751.97 feet to the northwesterly right -of -way line of Taylor
Loop Road, the side lines of said strip of easement are to be

ials, tooks, supplies and equipment and provide working space.

Sewer Committee and the Little Rock Wastewater Utility commence
the initial work on the permanent easement and shall terminate one

earlier. This temporary easement shall be upon the following
described lands situated in Pulaski County, Arkansas, to -wit:
And also a strip of temporary construction easement 25
feet in width lying southwesterly of, adjaodnt to, and
parallel with the permanent easement described above,
for use during initial sewer line construction only.
Upon completion of the initial or any subsequent work by the
Little Rock Sanitary Sewer Committee, the Little Rock Sanitary
Sewer Committee shall backfill and thoroughly compact all excava-

Sewer Committee and the Little Rock Wastewater Utility commence
the initial work on the permanent easement and shall terminate one
year after that date or when that work is completed, whichever is
earlier. This temporary easement shall be upon the following des-
cribed lands situated in Pulaski County, _Arkansas, to -wit:
And also a 25 -foot wide strip of temporary construction
easement lying northeasterly of, adjacent tq and parallel
with the permenent easement described above, for use dur-
ing initial sewer line construction only.
Upon completion of the initial or any subsequent work by the
Little Rock Sanitary Sewer Committee, the Little Rock Sanitary
Sewer Committee shall backfill and thoroughly compact all excava-
tions to minimize settling and shall level the surface over its
excavations and pipelines, remove all excess excavated materials
and debris and leave the premises in a clean sanitary condition.
If the initial or any subsequent work by the Little Rock Sanitary
Sewer Committee damages any fence, curb or paved surface upon the
rights -of -way, the Little Rock Sanitary Sewer Committee, at its
expense, shall repair or replace the damaged portion with materi-
als of like quality and as nearly as possible to its prior
condition.
The execution of this easement does not give the GRANTOR the
right to connect to or receive service from any sewer or waste-
water facility; the right to make connections and receive service
shall be subject to the rules, regulations, policies or ordinances
in effect at the time of application.
To have and to hold said easements, rights and privileges
unto the GRANTEE, and unto its successors and assigns forever, for
the purposes aforesaid.
And GRANTOR(S) covenants with GRANTEE, its succcessors and
assigns, that subject to prior recorded mortages and easements, if
any, it will forever warrant and defend the title to said ease-
ments and rights against the claims of all persons whomsoever and
that GRANTEE, its successors and assigns, shall have at all times
the quiet use and enjoyment of said easements and rights.

KNOW ALL MEN BY THESE PRESENTS: 1 O 2
THAT the City of Little Rock, GRANTOR, a corporation organ-
ized under and by virtue of the laws of the State of Arkansas, by
its Vice Mayor and City Clerk , duly authorized by proper
resolution of its Board of Directors, for and in consideration of
the sum of Dollars ($ ),
and other valuable consideration paid by the Little Rock Sanitary
Sewer Committee, the receipt of which is hereby acknowledged, do
hereby, subject to prior recorded mortgages and easements, if any,
grant, bargain, sell and convey unto the City of Little Rock,
Arkansas, for the use and benefit of the Little Rock Sanitary
Sewer Committee, GRANTEE, and unto its successors and assigns for-
ever, the following described easements:
1. A PERMANENT RIGHT, PRIVILEGE AND EASEMENT for the purpose
of permitting the Little Rock Sanitary Sewer Committee and the
Little Rock Wastewater Utility to clear and keep clear the surface
of the right -of -way and to (a) lay, construct, operate, maintain,
repair, replace, reconstruct, test, inspect and add sewer mains
and sewer lines whether one or more, and without the payment of
additional compensation therefor; (b) keeping the easement clear
of all buildings and other improvements of any kind; and (c) hav-
ing the right to free ingress and egress across adjacent lands of
the GRANTOR(S) to the lands hereinafter described. Subject to
prior easement of record and except as hereinafter stated, the
Little Rock Sanitary Sewer Committee shall have the exclusive use
of this right -of -way and easement; and the GRANTOR may hereinafter
use the surface of the easement for any purpose not inconsistent
with the rights hereby conveyed, but may not place a building,
footing, wall, structure, or other improvement upon the right -of-
way except that, after the intitial sewer construction is com-
pleted, the GRANTOR may pave the easement surface and may use it
for driveways, walks or parking areas. The GRANTOR may permit
other utility service to cross this easement at approximately
right angles, but only if such utilities first comply with what-
ever specifications the Little Rock Sanitary Sewer Committee and
the Little Rock Wastewater Utility may designate at the time for
the protection of its own facilities. This permanent easement
shall be upon the following described lands situated in Pulaski
County, Arkansas, to -wit:
A 25 -foot wide strip of permanent sanitary sewer easement
situated in Sections 15 and 16, T -2 -N, R -13 -W, Pulaski
County, Arkansas, the sides of said easement lying 12.5
feet right and left of the centerline more particularly
described as follows:
Commencing at the NW corner of said Section 16, thence S
87" 24' 51" E along the north line of Section 16 for a
distance of 4,559,41 feet to the west line of the City of
Little Rock Tract; thence along the west line of said tract
S 10° 18' 00" E, 1,250.18 feet and S 27" 51' 00" W, 749.03
feet to a Point of Beginning; thence along the centerline`
the following courses and distances: S 59" 29' 50" E,
1,214.46 feet; S 57° 53' 20" E, 732.18 feet; S 180 17'
05" E, 840.18 feet; S 450 36' 45" E, 209.09 feet; S 49°
35' 15" E 1,040.90 feet; S 49° 28' 40" E, 1393.18 feet
and S 040 54' 02" E, 205 feet to the ordinary high water
line of the Little Maumelle River; the sides of the ease-
ment to be lengthened of shortened to terminate on the
west line of the City of Little Rock Tract and the ordin-
ary high water line of Little Maumelle River; permanent
easement containing`3.234 acres (140,875 S.F.), more or less.
2. A TEMPORARY RIGHT, PRIVILEGE AND EASEMENT for the purpose
of permitting the Little Rock Sanitary Sewer Committee and the
Little Rock Wastewater Utility to remove all timber and obstruc-
tions therefrom and to make excavations, store excavated materi-
als, tools, supplies and equipment and provide working space.
