11772CI A 1 RESOLUTION NO. 11,772 2 A RESOLUTION AUTHORIZING THE CITY MANAGER TO 3 RENEW TOWING SERVICE CONTRACTS FOR AN 4 ADDITIONAL ONE -YEAR TERM WITH EACH WRECKER 5 COMPANY THAT EXECUTED A TOWING SERVICE 6 CONTRACT WITH THE CITY OF LITTLE ROCK IN 7 SEPTEMBER OF 2003; AND FOR OTHER PURPOSES. N X [to] 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 WHEREAS, the City has elected to use a rotation basis for contract wrecker service, and WHEREAS, after a competitive selection process in 2003, four companies were deemed to be responsible and responsive bidders, and a towing service contract was executed with each company; and WHEREAS, Section 1.01 of the Towing Service Contract provides that the term of the contract shall be from October 1, 2003 until midnight, September 30, 2004 and that the term may be extended one time for an additional one -year term if mutually agreed to in writing by the parties no less than ninety (90) days in advance of the expiration of the initial term; and WHEREAS, the City desires to renew the Towing Service Contract one time for an additional one -year term if all four wrecker companies are willing to renew their contracts with the City. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. If all four wrecker contractors are willing to renew their contracts with the City, the City Manager is authorized to renew the existing towing service [PAGE 1 OF 3] R.M. Wrxker S.+vr' 0 0 1 contracts one time for an additional one -year term under the same conditions and rates 2 of compensation with: 3 (A) Metro Towing & Recovery, Inc. of Little Rock, Arkansas; 4 (B) Routh Wrecker Service, Inc. of Little Rock, Arkansas; 5 (C) Trek Towing, LLC, of Little Rock, Arkansas; and 6 (D) Asher Wrecker Service, Inc. of Little Rock, Arkansas 7 Section 2. The term of these renewed towing service contracts shall be from 8 12:01 AM, October 1, 2004 to 12:00 Midnight, September 30, 2005. 9 Section 3. The towing service contract terms, conditions, and rates of 10 compensation shall not be changed unless modified or amended pursuant to Section 11 7.04 of the agreement. 12 Section 4. Severability. In the event any title, section, paragraph, item, sentence, 13 clause, phrase, or word of this resolution is declared or adjudged to be invalid or 14 unconstitutional, such declaration or adjudication shall not affect the remaining 15 portions of the resolution which shall remain in full force and effect as if the portion so 16 declared or adjudged invalid or unconstitutional was not originally a part of the 17 resolution. 18 Section 5. Repealer.
