WHEREAS, the City owns certain property at 221 East Capitol, 311 East Capitol, 61h and Cumberland, and certain property located at 5300 South Shackleford, Little Rock, Arkansas, which is currently used for the purpose of the Little Rock sanitary sewer system, and this property is currently occupied by both the Little Rock Wastewater Utility ( "LRWU "), operated by the Little Rock Sanitary Sewer Committee ( "LRSSC "), and Central Arkansas Water ( "CAW "); and, WHEREAS, both LRWU and CAW need to expand their respective occupancies of the property and they are willing to make the transfer of LRSSC's interest to CAW in accordance with a certain written contract between them so that LRWU can relocate offices elsewhere and CAW can expand its current offices at that location; WHEREAS, the City believes that the proposed transfer is reasonable, and in the public interest, as well as the best interest of both LRSSC and CAW; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The Mayor and City Clerk are authorized to execute any documents approved by the City Attorney that are necessary to transfer title of the property referred to in the first paragraph herein to or from CAW and its assigns this transfer is approved, accordingly. In the event any title, section, paragraph, item, sentence, 2 clause, phrase, or word of this resolution is declared or adjudged to be invalid or 3 unconstitutional, such declaration or adjudication shall not affect the remaining 4 portions of the resolution which shall remain in full force and effect as if the portion so 5 declared or adjudged invalid or unconstitutional was not originally a part of the 6 resolution. 7 Section 3. Repealer.
