3 A RESOLUTION TO APPROVE AN ANNUAL CONTRACT WITH
4 VARIOUS VENDORS FOR THE PURCHASE OF ASPHALTIC
5 MATERIALS FOR THE OPERATIONS STREET DIVISION OF THE
6 PUBLIC WORKS DEPARTMENT; AND FOR OTHER PURPOSES.

8 WHEREAS, the City advertised formal Bid No. C04005 to solicit proposals for an
9 annual contract for asphaltic materials for the Street Division of the Public Works
10 Department, and the City opened the proposals received on February 26, 2004, and
11 WHEREAS, bids were received from various vendors for each item on the bid
12 proposal, as set forth in Attachment "A" hereto.
13 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
14 THE CITY OF LITTLE ROCK, ARKANSAS:
15 Section 1. The City Manager is authorized to enter into agreements with the

vendors submitting the low bid meeting the specification for each item listed on the bid
proposal, in a total amount not to exceed Fifty Thousand and no /100 Dollars
($50,000.00) for the annual contract for asphaltic materials for the Operations Street
Division of the Public Works Department.
Section 2. Funds for this agreement are to be allocated from Account No. 200-
220 - 2210 -3020.
Section 3. Severability. In the event any portion of this resolution is declared or
adjudged to be invalid or unconstitutional, such declaration or adjudication shall not
affect the remaining portions of this resolution, which shall remain in full force and
effect as if the portion so declared or adjudged invalid or unconstitutional was not
originally a part of this resolution.

Section 4. Repealer. All ordinances and resolutions, and parts thereof, which
are in conflict with any provision of this resolution are hereby repealed to the extent of
such conflict.
