116500 0 1 RESOLUTION NO. 11,650 2 3 A RESOLUTION TO ESTABLISH THE PROJECTS FOR WHICH LIMITED 4 TAX GENERAL OBLIGATION CAPITAL IMPROVEMENT BOND 5 PROCEEDS WILL BE EXPENDED; AND FOR OTHER PURPOSES. 6 7 WHEREAS, at the special election held November 4, 2003, the citizens of Little 8 Rock approved the issuance of limited tax general obligation capital improvement 9 bonds for various purposes, and 10 WHEREAS, pursuant to Little Rock, Ark., Ordinance No. (December 11 16, 2004) (the 'Bond Ordinance'), the Board of Directors authorized the issuance of 12 seventy million six hundred and thirty-five thousand dollars ($70,365,000) of such 13 bonds, and 14 WHEREAS, prior to the election the City listed the projects that it intended to 15 fund with the proceeds of such bonds, and 16 WHEREAS, the listed projects are within the purposes of the ballot questions 17 that were approved by the voters, and 18 WHEREAS, this resolution is intended to provide the legislative mandate to 19 limit the use of the bond proceeds available for projects to the listed projects and is to be 20 followed absent some extraordinary circumstance such as the availability of money 21 from grants, foundations or similar sources which permits the extension of a listed 22 project, or the entire funding of such a project, in which case the Board shall amend this 23 resolution and identify other similar projects to be funded with the bond proceeds 24 unless such proceeds are used to retire bonds, 25 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF 26 THE CITY OF LITTLE ROCK, ARKANSAS, [PAGE 1 OF 91 Resolution To Direct use of Limited Obligation Capital Improvement Bond Proceeds 0 0 1 Section 1. The bond proceeds for the ballot question on Fire Department 2 Improvements shall be spent on the following projects: 3 (a) Phase II improvements to the Fire Training Academy; 4 (b) Renovations to existing fire stations within the City; 5 (c) The purchase of emergency generators for fire stations within the 6 City. 7 Section 2. The bond proceeds for the ballot question on Police Department 8 Improvements shall be spent on the following projects: 9 (a) The purchase of emergency generators for police facilities within to the City; 11 (b) The costs of locating and constructing a police service center in 12 downtown Little Rock; 13 (c) The purchase of crime detection equipment. 14 Section 3. The bond proceeds for the ballot question on Police, Fire and 15 Emergency Communications Improvements shall be spent on the following projects: 16 (a) Improvements to the police and fire radio systems; 17 (b) Improvements to the City's early warning system; 18 (c) The creation of a 3 -1 -1 general information telephone system. 19 Section 4. The bond proceeds for the ballot question on Street Improvements 20 shall be spent on the following projects: 21 A. The bond proceeds for the ballot question on School Area mprovement shall be spent on the following projects: The improvement of pedestrian safety at Bale Elementary; The improvement of pedestrian safety at Fair Park Elementary; The improvement of pedestrian safety at Franklin Elementary; The improvement of pedestrian safety at Mabelvale Middle; The improvement of pedestrian safety at Baseline Elementary; The improvement of pedestrian safety at Forest Park Elementary; The improvement of pedestrian safety at Mabelvale Elementary; The improvement of pedestrian safety at Stephens Elementary. The bond proceeds for the ballot question on Animal Services 16 Facility Improvements shall be spent on projects to be developed based on input from 17 the Animal Services Advisory Board and other interested citizens and parties, provided 18 that, in general, these improvements will include a facility to allow the holding of 19 animals for a longer time to minimize euthanasia rates; to provide space necessary for 20 educational programs to support the objective of increased adoption rates; and, other 21 improvements such as increased space for isolation areas to allow for disease screening, 22 better separation of dogs and cats, and to meet requirements for special need animals. 23 Section 9. The bond proceeds for the ballot question on Robinson and 24 Statehouse Convention Centers Improvements shall be spent on the following projects: 25 (a) Robinson Center improvements including the reconstruction, 26 renovation, or remodeling of entertainment and meeting facilities; (PACE 7 OF 91 Resolution To Direct use of Limited Obligation Capital Improvement Bond Proceeds 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 0 0 (b) Statehouse Convention Center facility improvements including the reconstruction, renovation, or remodeling of entertainment and meeting facilities. Section 10. It is the intent of the Board of Directors that the use of the bond proceeds for the projects listed above is to occur absent some extraordinary circumstance such as the availability of money from grants, foundations or similar sources which permits the extension of a listed project, or the entire funding of such a project, in which case the Board shall amend this resolution and identify other similar projects to be funded with the bond proceeds unless such proceeds are otherwise used to retire outstanding bonds. This resolution is not a contract with the bondholders and may be amended from time to time by the Board without the consent of the bondholders. This resolution limits the use of bond proceeds available for projects and does not in any manner place any limitation on the use of bond proceeds to pay expenses of issuing and insuring the bonds and to fund capitalized interest as authorized by the Bond Ordinance. 16 Section 11. Severability. In the event any title, section, paragraph, item, 17 18 19 20 21 22 23 24 25 26 27 sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the resolution. Section 12. Repealer. All ordinances and resolutions, including but not limited to Little Rock, Ark., Ordinance No. 18,798 (December 17, 2002) ( "the 2003 Budget Ordinance "), are hereby repealed to the extent of such inconsistency; provided, however, that this resolution shall not in any manner repeal or modify any provisions of the Bond Ordinance.
