A RESOLUTION TO SET A PUBLIC HEARING ON DECEMBER 16,
2003, TO CONSIDER AN ORDINANCE AUTHORIZING THE
ISSUANCE OF SEWER REVENUE BONDS FOR THE PURPOSE OF
FINANCING THE REHABILITATION AND IMPROVEMENT OF
THE SANITARY SEWER COLLECTION SYSTEM; AND FOR
OTHER PURPOSES.
WHEREAS, the City of Little Rock, Arkansas (the "City") owns a Sewer System (the
"System "), which is operated by the Sewer Committee of the City (the "Committee "); and
WHEREAS, the Committee has determined that rehabilitations and improvements
to the collection portion of the System are necessary in order for the Little Rock Wastewater
Utility to make the services of the System adequate for the needs of the City and to provide
quality sanitary sewer service to the City and its inhabitants; and
WHEREAS, additionally, on January 13, 2000, the Sierra Club filed a lawsuit against
the Committee alleging violations of the Committee's two National Pollutant Discharge
Elimination System ( "NPDES ") permits and the Clean Water Act regarding sanitary sewer
overflows occurring within the System; and
WHEREAS, on September 12, 2001, the Committee and the Sierra Club entered into
a Settlement Agreement whereby the Committee agreed to address and correct sanitary
sewer overflows occurring within the System; and
WHEREAS, the issuance of sewer revenue bonds for the purpose, among others, of
financing all or a part of the rehabilitation of the collection portion of the System will assist
the Committee in its compliance with the terms and
Settlement Agreement.

1 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
2 THE CITY OF LITTLE ROCK, ARKANSAS:
3 Section 1. That December 16, 2003, at 6:00 p.m. shall be the date and time for a
4 public hearing to consider an Ordinance authorizing the issuance of up to $14,000,000 in
5 principal amount of Sewer Revenue Bonds, Series 2004B for the purpose of financing the
6 rehabilitation and improvement of the collection portion of the System.
