116241 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 E RESOLUTION NO. 11,624 0 A RESOLUTION TO PERMIT THE CENTRAL ARKANSAS TRANSIT AUTHORITY TO OVERSEE THE BUS BENCH FRANCHISE WITHIN THE CITY OF LITTLE ROCK, ARKANSAS, SUBJECT TO CERTAIN CONDITIONS; AND FOR OTHER PURPOSES. WHEREAS, for many years the City has granted a bus bench franchise to an entity to control the advertising on bus benches located within the City, and WHEREAS, the City has entered into an interlocal agreement with other communities in central Arkansas for a transit system operated by the Central Arkansas Transit Authority (CATA), and WHEREAS, after consideration it has been determined that CATA could more easily oversee bench buses within the City, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The City Manager is authorized to enter into an agreement to permit the Central Arkansas Transit Authority to oversee bus bench advertisements, locations, and specifications, within the corporate limits of the City of Little Rock, Arkansas. 18 Section 2. Notwithstanding any other provision of this resolution, the City 19 reserves the right to do the following 20 (a) To insist upon the removal of any bus bench within City right -of -way 21 that is not located a bus stop approved by CATA, and if such removal 22 does not occur voluntarily, to remove the bus bench and charge the owner 23 the actual costs of removal, or a minimum fee of fifty dollars ($50.00), for 24 the removal of the bus bench. 25 PT-1 27 (b) To direct CATA to require that any or all bus benches within the corporate limits of the City be covered by a protective shelter made of materials acceptable to the City Manager, or designee. Any franchise fee collected for advertisements on any bus bench 2 located within the corporate limits of the City shall be paid to CATA. 3 Section 4. Severability. In the event any title, section, paragraph, item, sentence, 4 clause, phrase, or word of this resolution is declared or adjudged to be invalid or 5 unconstitutional, such declaration or adjudication shall not affect the remaining 6 portions of the resolution which shall remain in full force and effect as if the portion so 7 declared or adjudged invalid or unconstitutional was not originally a part of the 8 resolution. 9 Section 5. Repealer.
