3 A RESOLUTION TO APPROVE THE 2004 ACTION PLAN FOR
4 CDBG, HOME, AND ESG FUNDS; TO AUTHORIZE THE CITY
5 MANAGER TO SUBMIT THE ACTION PLAN FOR
6 CONSIDERATION BY THE U.S. DEPARTMENT OF HOUSING
7 & URBAN DEVELOPMENT; AND FOR OTHER PURPOSES.

9 WHEREAS, the City has access to Community Development Block Grant
10 ( "CDBG "), HOME Investment Partnership Program ( "HOME ") and Emergency Shelter
1 I Grant ( "ESG ") funds on an annual basis, and
12 WHEREAS, the use of these monies mandates that an action plan for those funds
13 be submitted to the U.S. Department of Housing & Urban Development by November
14 15, 2003, in accordance with Title I of the Cranston - Gonzalez National Affordable
15 Housing Act of 1990, and
16 WHEREAS, after extensive public discussion and citizen participation, including
17 neighborhood meetings, and a public hearing, a plan has been developed for
18 submission.
19 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
20 THE CITY OF LITTLE ROCK, ARKANSAS:
21 Section 1. The City Manager is hereby authorized to submit the 2004 Action
22 Plan for the use of CDBG, HOME, and ESG Entitlement Funds to the U.S. Department
23 of Housing and Urban Development by November 15, 2003, in accordance with the
24 provisions of the Cranston - Gonzalez National Affordable Housing Act of 1990.
25 Section 2. The projected uses of these funds were approved by adoption of Little
26 Rock, Ark., Resolution No. 11,594 (September 9, 2003).

1 Section 3. Severability. In the event any section, subsection, subdivision,
2 paragraph, subparagraph, item, sentence, clause, phrase, or word of this resolution is
3 declared or adjudged to be invalid or unconstitutional, such declaration or adjudication
4 shall not affect the remaining portions of this resolution, which shall remain in full force
5 and effect as if the portion so declared or adjudged invalid or unconstitutional were not
6 originally a part of this resolution.
7 Section 4. Repealer. All laws, ordinances, resolutions, policies, or parts of any
8 such material, in conflict with the provisions of this resolution are hereby repealed to
9 the extent of such inconsistency.
