115800 6 I RESOLUTION NO. 11,580 9 3 A RESOLUTION TO SUPPORT ENTRY INTO A 4 MEMORANDUM OF UNDERSTANDING WITH PULASKI 5 COUNTY, ARKANSAS, TO COOPERATE ON EMERGENCIES 6 AND DISASTERS; AND FOR OTHER PURPOSES. 7 8 WHEREAS, Arkansas Statute 12 -75 -119 authorizes mutual aid agreements 9 between cities and counties in order to assure and assist with adequate resources in the 10 event of a disaster or significant emergency; and I 1 WHEREAS, the stipulations for receipt of certain federal grants for public safety 12 and emergency management programs require mutual aid agreements with 13 neighboring communities, and 14 WHEREAS, the proposed agreement attached as Exhibit A to this Resolution 15 accomplishes this purpose and will assist in the preservation of lives and property in 16 the event of a disaster emergency. 17 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF 18 THE CITY OF LITTLE ROCK, ARKANSAS: 19 Section 1. Pursuant to the authority set forth in Ark. Code Ann. § 12 -75 -119 20 (Michie Supp. 2003), the City Manager, or at his direction the Emergency Management 21 Administrator, is authorized to execute a mutual aid agreement in a form substantially 22 the same as Exhibit A to this Resolution in order to enhance public safety, preserve life 23 and property in the event of a disaster emergency, and to enable the receipt of federal 24 grant funds for the purpose of enhancing public safety or emergency management 25 programs for the benefit of the City and its environs. In the event any title, section, paragraph, item, 2 sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid 3 or unconstitutional, such declaration or adjudication shall not affect the remaining 4 portions of the resolution which shall remain in full force and effect as if the portion so 5 declared or adjudged invalid or unconstitutional was not originally a part of the 6 resolution. 7 Section 3. Repealer. Carpenter, City Attorney 19 20 21 // 22 // 23 // 24 // 25 // 26 27 [PAGE 2 OF 41 Resolution To authorize Memorandum of Understanding With Pulaski County for Public Safety Programs 0 MUTUAL AID AGREEMENT 0 2 FOR THE CITY OF LITTLE ROCK OFFICE OF 3 EMERGENCY SERVICES AND THE PULASKI COUNTY 4 OFFICE OF EMERGENCY MANAGEMENT 5 6 WHEREAS, there is a great need for the City of Little Rock Office of Emergency 7 Services and the Pulaski County Office of Emergency Management to cooperate 8 together for better and more efficient emergency and disaster response capabilities for 9 the City and the County; and 10 WHEREAS, life and property can be saved by this agreement; I1 NOW, THEREFORE, this agreement is entered into by the City of Little Rock 12 Office of Emergency Services and the Pulaski County Office of Emergency Management 13 to permit the City of Little Rock Office of Emergency Services to call for the assistance of 14 the Pulaski County Office of Emergency Management or for the Pulaski County Office 15 of Emergency Management to call for the assistance of the City of Little Rock Office of 16 Emergency Services to assist in emergency and disaster response operations on the 17 following terms and conditions: 18 FIRST, the City of Little Rock has passed a resolution approving the terms of this 19 agreement and authorizing the City Manager and the City of Little Rock Office of 20 Emergency Services Director to sign this agreement. 21 SECOND, Pulaski County Quorum Court has passed a resolution approving the 22 terms of this agreement and authorizing the Pulaski County Judge and the Pulaski 23 County Office of Emergency Management Director to sign this agreement. 24 THIRD, the City of Little Rock's City Manager and the City of Little Rock Office 25 of Emergency Services' Director do hereby acknowledge that the Pulaski County Office [PAGE 3 OF 41 Resolution To authorize Memorandum of Understanding Willi Pulaski County for ILblic Safety Nrograns 0 1 of Emergency Management has permission to respond to the City of Little Rock, upon 2 request. 3 FOURTH, Pulaski County Quorum Court, Pulaski County Judge, and Pulaski 4 County Office of Emergency Management Director do hereby acknowledge that the 5 City of Little Rock Office of Emergency Services has permission to respond to Pulaski 6 County, upon request. 7 FIFTH, by this agreement if the City of Little Rock responds to a declared 8 incident by the County to provide mutual aid, third party reimbursement may be 9 allowed for the cost of recovery. 10 SIXTH, by this agreement if Pulaski County responds to a declared incident by 11 the City to provide mutual aid, third party reimbursement may be allowed for the cost 12 of recovery. 13 By this agreement, both the City of Little Rock Office of Emergency Services and 14 the Pulaski County Office of Emergency Management make a good -faith commitment 15 to aid and assist each other if called on to do so. 16 This agreement is subject to cancellation on the first of any month after giving or 17 receiving 30 days notice of cancellation. 18 Signed for City of Little Rock Signed for Pulaski County 19 20 21 City of Little Rock City Manager Pulaski County Judge 22 23 24 City of Little Rock OEM Director Pulaski County OEM Director 25 Dated: 26 27 28 29 Witnessed City of Little Rock Clerk Resolution reauthorize Memorandum of Understanding With Pulaski County for Public Safety Programs Witnessed Pulaski County Clerk EXHIBIT "A" [PAGE 4 OF 41
