3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO
4 ENTER INTO A CONTRACT WITH CUMMINS MID -SOUTH
5 L.L.C. FOR PURCHASE OF A REPLACMENT GENERATOR
6 AND UNINTERRUPTIBLE POWER SYSTEM; AND FOR OTHER
7 PURPOSES.

9 WHEREAS, the generator and uninterruptible power equipment that provides
10 emergency backup power for the City computer network, telephone PBX system, and
11 the E911 dispatch facility has failed to operate on three separate power system tests this
12 year, causing a service outage each time, and
13 WHEREAS, the current power system was installed in 1987 and replacement
14 parts are expensive and very difficult to obtain, and
15 WHEREAS, an upgrade will provide a reliable source of back -up power for the
16 vital services provided by OIT and OES, and
17 WHEREAS, pursuant to Bid No. 03231, Cummins Mid - South, L.L.C. submitted
18 the lowest responsible and responsive bid for such replacement generator and
19 uninterruptible power system, said bid being in the amount of Eighty-seven Thousand,
20 Three Hundred Thirty-seven and no /100 Dollars ($87,337.00), plus taxes.
21 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
22 THE CITY OF LITTLE ROCK, ARKANSAS:
23 Section 1. The Board of Directors hereby authorizes the City Manager to enter
24 into a contract with Cummins Mid - South, L.L.C. for the purchase of a replacement
25 generator and uninterruptible power system to provide backup power for the City

2 Little Rock, in the amount of Eighty-seven Thousand, Three Hundred Thirty-seven
3 Dollars and no /100 Dollars ($87,337.00), plus taxes.
4 Section 2. Funds for this purchase are available in Account #223 - 220 - 7119 -8010 -
5 2003 Short -Term Financing.
6 Section 3. Severability. In the event any title, section, paragraph, item, sentence,
7 clause, phrase, or word of this resolution is declared or adjudged to be invalid or
8 unconstitutional, such declaration or adjudication shall not affect the remaining
9 portions of the resolution which shall remain in full force and effect as if the portion so
10 declared or adjudged invalid or unconstitutional was not originally a part of the
11 resolution.
12 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that
13 are inconsistent with the provisions of this resolution, are hereby repealed to the extent
14 of such inconsistency.
15 Section 5. This resolution shall be in full force and effect from and after its
16 adoption.
