114920 0 1 RESOLUTION NO. 11,492 2 3 A RESOLUTION TO AUTHORIZE AN AGREEMENT WITH THE 4 CENTRAL ARKANSAS TRANSIT AUTHORITY TO PROVIDE AN 5 ADDITIONAL CAPITAL CONTRIBUTION FOR PHASE I OF THE 6 RIVER RAIL PROJECT; TO CONFIRM AN INTENT TO CONTRIBUTE 7 TO RIVER RAIL OPERATIONS; TO CONFIRM AN INTENT TO FUND 8 A LEVEL OF BUS SERVICES; AND FOR OTHER PURPOSES. 9 10 WHEREAS, pursuant to Little Rock, Ark., Resolution No. 7545 (January 21, 11 1986), as amended by Little Rock, Ark., Resolution No. 7567 (March 5, 1986), and by 12 Little Rock, Ark., Ordinance No. 15,860 (May 1, 1990), the City entered into an 13 agreement to create the Central Arkansas Transit Authority (CATA), in order to 14 establish a public transit system within the boundaries of Pulaski County, Arkansas, 15 and 16 WHEREAS, the City, in further partnership with CATA members Pulaski 17 County, and the City of North Little Rock, desires to establish a regional light rail 18 transportation system, and 19 WHEREAS, pursuant to this desire for a regional light rail transportation system 20 the City has made a specific appropriation for a light rail system in each budget 21 ordinance since 1998, as set forth in Little Rock, Ark., Ordinance No. 17,646 (December 22 16, 1997); Little Rock, Ark., Ordinance No. 17,897 (December 15, 1998); Little Rock, Ark., 23 Ordinance No. 18,174 (December 20, 1999); Little Rock, Ark., Ordinance No. 18,409 24 (December 26, 2000); Little Rock, Ark., Ordinance No. 18,607 (December 18, 2001); and, 25 Little Rock, Ark., Ordinance No. 18,798 (December 17, 2002), and [PAGE 1 OF 31 Resolution Authorization of Capital Contribution to CATA for light rail service 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 0 WHEREAS, CATA, at the previous request of the City, Pulaski County and the City of North Little Rock has undertaken actions to begin the development of a regional light rail transportation system, and WHEREAS, CATA has taken public bids for the development of the regional light rail transportation system and an additional contribution from the City is required, and WHEREAS, the City, Pulaski County, the City of North Little Rock and CATA intend to fund additional costs for the construction and operation of the regional light rail transportation system, and to declare an intent to provide adequate funding levels for the regional bus transportation system, and WHEREAS, to fully define the nature of this relationship between Little Rock, North Little Rock, and Pulaski County, it is appropriate over the next ninety (90) days to develop and consider a supplemental agreement between these public bodies that establishes a budget for the projection, and which outlines the specifics for the construction, maintenance and operation of this unique aspect of public transportation in central Arkansas, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: 19 Section 1. The City's contribution for construction of the regional light rail 20 21 22 23 24 25 26 transportation system is set at one million, one hundred ninety-eight thousand, six hundred forty-one dollars ($1,198,641.00). Section 2. The City intends to make a reasonable annual contribution for the regional bus transportation system that is based upon such factors as previous annual contributions, and the needs to fund adequate services for the central Arkansas area. Section 3. As long as the cities of Little Rock and North Little Rock, and Pulaski County, actively pursue a supplemental agreement to define and set forth more fully Resolution Authorization of Capital Contribution to CATA for light rail service [PAGE 2 OF 31 0 0 1 the obligations of these governments towards the River Rail project, the City intends to 2 fulfill its current understanding to provide for one -third (1/3) of the net cost of the 3 regional light rail transportation. For purposes of this Resolution, "net cost" is defined 4 as the costs of construction, and the direct operational expenses of the regional light rail 5 transportation system less direct operational revenues collected and grants received for 6 the regional light rail transportation system. 7 Section 4. The Mayor is authorized to sign an agreement with CATA that is S consistent with the provisions of this Resolution. 9 Section 5. Severability. In the event any title, section, paragraph, item, to sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid 11 or unconstitutional, such declaration or adjudication shall not affect the remaining 12 portions of the resolution which shall remain in full force and effect as if the portion so 13 declared or adjudged invalid or unconstitutional was not originally a part of the 14 resolution. 15 Section 6. Repealer.
