11481• •2003027638 03/25/2003 01:13:33 PH Filed 8 Recorded in Official Records of 1 RESOLUTION NO. 11,481 PULASKI COUNTY CIRCUIT /COUNTY CLERK 2 Fees $17.00 3 A RESOLUTION TO ESTABLISH A PROCESS TO DETERMINE 4 WHETHER TO ISSUE LETTERS OF SUPPORT FOR FINANCING 5 MECHANISMS OFFERED BY THE ARKANSAS DEVELOPMENT 6 FINANCE AUTHORITY; AND FOR OTHER PURPOSES. 7 N WHEREAS, the Arkansas Development Finance Authority (ADFA) supports 9 affordable housing developments, and provides a variety of finance mechanisms such 10 as Low- Income Housing Tax Credits and Volume Cap Bonds, to do so, and 11 WHEREAS, a developer that seeks the benefit of one of these ADFA finance 12 mechanisms must include with an application a letter of support from the mayor of the 13 municipality where the proposed project is located, and 14 WHEREAS, the Board of Directors of the City of Little Rock wishes to establish a 15 process that will ensure that all such requests receipt a comprehensive review by staff 16 and the local citizens, 17 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF 18 THE CITY OF LITTLE ROCK, ARKANSAS: 19 Section 1. No letter of support from the Mayor, or any other City official, with 20 regards to an Arkansas Development Finance Authority financing application shall be 21 issued unless the following steps have been met: 22 (A) The request for such a letter has been presented to the Mayor, or 23 the City Manager, at least sixty (60) days prior to the date such a 24 letter is needed and should include complete information about the 25 project, and the proposed location; 26 (B) If the letter is received by the Mayor, a copy shall 27 the City Manager immediately; [PAGE 1 OF 4] Resolution Process to approve letters of support for ADFA projed 0 0 I (C) The City Manager shall review the letter, and forward the 2 information to the Department of Planning and Development, the 3 Department of Housing & Neighborhood Programs, and to the 4 Board of Directors for the following review: 5 (1) The Department of Planning & Development staff shall: 6 (a) Review the request to determine if the proposed 7 project is a compatible land use, and if the project is 8 consistent with the existing zoning classification; and 9 (b) If plans are available, review the proposed landscape, 10 parking and setback aspects of the project; and 11 (2) The Department of Housing & Neighborhood Development 12 staff shall: 13 (a) Review the request to determine the consistency of 14 the proposed project with the City's adopted 15 Consolidated Plan as it relates to CDBG and Housing 16 programs; and 17 (b) Transmit a copy of the request, with a cover sheet 18 that asks that any comments be sent back to the 19 Department of Housing & Neighborhood Programs 20 within thirty (30) days of the date of the transmittal, 21 to any neighborhood association that has boundaries 22 within the Planning District in which the proposed 23 project is to be located; and 24 (c) Post a copy of the request in the nearest City Alert 25 Center; and 26 (D) After the review has been conducted, each Department shall 27 respond to the City Manager with a report, in the format set forth [PAGE 2 OF 4] Resolution Process to approve letters of support for ADFA pmjen • I below, which shall be placed before the Board of Directors at the 2 next available Board of Director Agenda for consideration: 3 4 5 6 7 8 10 Staff Review of Requested Support Letters For Project Funded Through The Arkansas Development Finance Authority Project: Department: Contact Person: Comments/Recommendation: 11 Section 2. If authorized by the Board of Directors to do so, the Mayor shall 12 issue the requested letter of support. 13 Section 3. Nothing in this procedure shall permit the Board of Directors to 14 refuse authorization of an ADFA letter of support for any reason which violates federal 15 or state antidiscrimination laws or regulations. 16 Section 4. The City Manager shall take the process outlined in this Resolution 17 and make it a part of the procedural manual for City departments. 18 Section 5. Severability. In the event any title, section, paragraph, item, 19 sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid 20 or unconstitutional, such declaration or adjudication shall not affect the remaining 21 portions of the resolution which shall remain in full force and effect as if the portion so 22 declared or adjudged invalid or unconstitutional was not originally a part of the 23 resolution. 24 Section 6. Repealer.
