113911 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 0 0 RESOLUTION NO. 11,391 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER INTO AN ANNUAL PURCHASE ORDER WITH FLEMING ELECTRIC, INC., TO PROVIDE ELECTRICAL SERVICE AS NEEDED; AND FOR OTHER PURPOSES. WHEREAS, the City periodically needs additional electrical repair services to augment the electrical staff of the City, but at the time such services are needed it is impractical to use formal competitive bidding to provide such service, and WHEREAS, the City annually submits a formal request for proposals (RFP) to select an individual, or company, to provide these electrical services as needed, and WHEREAS, on September 5, 2002, RFP No. CO2023 for electrical services was published, and of the four responses received it was determined that Fleming Electric, Inc., was the lowest responsible and responsive bidder, and that Little Rock Electrical Contractors, submitted the second lowest responsible and responsive bid, and WHEREAS, the City Manager recommends that the City enter into an agreement with Fleming Electric, Inc., to provide electrical services as needed, and in the event these services cannot be provided, or additional services are required, to permit the City to contract with Little Rock Electrical Contractors, for such services, NOW, THEREORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: 23 Section 1. The City Manager is authorized to enter into an agreement with 24 Fleming Electric, Inc., to provide electrical services to the City, as needed, in accordance 25 with the response submitted by Fleming to RFP No. CO2023. In the event that neither the City, nor Fleming Electric, Inc., is 2 available to provide such electrical services when needed by the City, the City Manager is 3 authorized to use Little Rock Electrical Contractors to provide such service in accordance 4 with the response it submitted to RFP No. CO2023. 5 Section 3. Severability. In the event any title, section, paragraph, item, sentence, 6 clause, phrase, or word of this resolution is declared or adjudged to be invalid or 7 unconstitutional, such declaration or adjudication shall not affect the remaining portions 8 of the resolution which shall remain in full force and effect as if the portion so declared or 9 adjudged invalid or unconstitutional was not originally a part of the resolution. 10 Section 4. Repealer.
