3 A RESOLUTION TO AUTHORIZE A CONTRACT WITH SMITH
4 DIRECTIONAL BORING, LLC, TO CONSTRUCT RESTROOM FACILITIES
5 IN MacARTHUR PARK; AND FOR OTHER PURPOSES.

7 WHEREAS, in January, 1999, a tornado destroyed the original restroom facilities in
8 MacArthur Park, blew down a number of trees, and damaged other buildings within the
9 Park, and
10 WHEREAS, MacArthur Park is a heavily used park that adjoins the University of
11 Arkansas at Little Rock School of Law, the Arkansas Arts Center, and the MacArthur
12 Military History Museum, so there is a need for proper restroom facilities on the grounds,
13 and
14 WHEREAS, the Quapaw Historic District Commission has reviewed and approved
15 the plans for this facility, and
16 WHEREAS, pursuant to a competitive bidding process that attracted bids from
17 eight different firms it was determined that Smith Directional Boring, LLC, was the lowest
18 responsible and responsive bidder,
19 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
20 THE CITY OF LITTLE ROCK, ARKANSAS:
21 Section 1. The City Manager is authorized to enter into an agreement with Smith
22 Directional Boring, LLC, in an amount not to exceed fifty-nine thousand four hundred and
23 two dollars and seventy-eight cents ($59,402.78) for the construction of restroom facilities
24 in MacArthur Park.
25 Section 2. Funds for this contract are available in Account No. 700 - 230 -X002
26 pending reimbursement from a matching grant that the City has received for these
27 improvements; further, donated funds are available in Account No. 210 - 230 -13157 in the

1 amount of thirteen thousand six hundred and ten dollars and thirty-one cents ($13,610.31)
2 as part of the City's match portion of available grant funds.
3 Section 3. Severability. In the event any title, section, paragraph, item, sentence,
4 clause, phrase, or word of this resolution is declared or adjudged to be invalid or
5 unconstitutional, such declaration or adjudication shall not affect the remaining portions
6 of the resolution which shall remain in full force and effect as if the portion so declared or
7 adjudged invalid or unconstitutional was not originally a part of the resolution.
8 Section 4. Repealer. All ordinances and resolutions are hereby repealed to the
9 extent of such inconsistency.
