113081 2 0 RESOLUTION NO. 11,308 0 3 A RESOLUTION TO AUTHORIZE AN AGREEMENT WITH MIDWEST 4 EMPLOYERS' CASUALTY COMPANY TO PROVIDE WORKERS' 5 COMPENSATION REINSURANCE COVERAGE TO THE CITY; AND FOR 6 OTHER PURPOSES. Fi 8 WHEREAS, the City operates a self- funded workers' compensation program 9 pursuant to state law, but is required to maintain reinsurance in order to adequately 10 provide for such coverage, and 11 WHEREAS, on May 10, 2002, the City issued RFP if 02238, and in response to this 12 formal Request for Proposals it was determined that this bid from Midwest Employers' 13 Casualty Company was the most appropriate coverage package for a contract that will 14 begin on July 1, 2002, 15 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF 16 THE CITY OF LITTLE ROCK, ARKANSAS: 17 Section 1. The City Manager is authorized to enter into an agreement with 18 Midwest Employers' Casualty Company for workers' compensation reinsurance in an 19 amount not to exceed seventy-five thousand two hundred and seventy-nine dollars 20 ($75,279.00), for the period from July 1, 2002, to June 30, 2003, with the City to maintain a 21 self - insured retention of four hundred thousand dollars ($400,000.00) as a maximum cost 22 per incident. 23 Section 2. Funds for this agreement are available in the 2002 City Budget line 24 item for Workers' Compensation costs in Account No. 100 - 010 - 6510 -1250. In the event any title, section, paragraph, item, sentence, 2 clause, phrase, or word of this resolution is declared or adjudged to be invalid or 3 unconstitutional, such declaration or adjudication shall not affect the remaining portions 4 of the resolution which shall remain in full force and effect as if the portion so declared or 5 adjudged invalid or unconstitutional was not originally a part of the resolution. 6 Section 4. Repealer.
