112981 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 6 0 RESOLUTION NO. 111,298 A RESOLUTION TO AUTHORIZE AN AGREEMENT WITH THE ARCHITECTURAL FIRM OF WITTENBERG, DELONY & DAVIDSON TO DESIGN A PARKING GARAGE FACILITY FOR THE RIVER MARKET AREA, AND FOR OTHER PURPOSES. WHEREAS, the City has considered the creation of a parking garage in the River Market area, and WHEREAS, in Little Rock, Ark., Resolution No. 11,245 (April 2, 2002), the Board of Directors authorized entry into agreements with the firm of Morgan Keegan as bond underwriters, and with Wright, Lindsey & Jennings, as bond counsel, and WHEREAS, in order to facilitate the construction of such a garage the City had previously advertised a request for qualifications for an architecture firm to design a structure of not more than 800 parking spaces which would also include up to 20,000 square feet of retail space, and WHEREAS, a selection committee interviewed nine different firms for the project and concluded that the most qualified firm is Wittenberg, Delony & Davidson, and WHEREAS, the City is ready to proceed with the steps for the issuance of revenue bonds, the proceeds of which will finance the design, acquisition, and construction of this parking garage, and would like to have the architectural work on this project undertaken as quickly as possible, particularly since the cost for such work can be paid from the proceeds of the revenue bond issue, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: 25 Section 1. The City Manager is authorized to enter into an agreement under 26 terms acceptable to the City Attorney, and not relying solely upon the language of the 27 form AIA contract, with the firm of Wittenberg, Delony & Davidson, for the architectural [PAGE 1 OF 2] Resolution Selection of architecture firm for River Market Parking Garage 1 design of a parking garage with not to exceed 800 spaces, and room for up to 20,000 square 2 feet of retail space, to be located in the River Market District of the City. 3 Section 2. The value of this contract is to be set at six percent (6 %) of the 4 construction cost of the parking garage, but in any event is not to exceed the sum of five 5 hundred thousand dollars ($500,000.00). 6 Section 3. The funds for this Agreement are to be paid from the proceeds of a 7 revenue bond issue that will be issued to finance the acquisition, design and construction 8 of this parking garage. 9 Section 4. Severability. In the event any title, section, paragraph, item, sentence, 10 clause, phrase, or word of this resolution is declared or adjudged to be invalid or 11 unconstitutional, such declaration or adjudication shall not affect the remaining portions 12 of the resolution which shall remain in full force and effect as if the portion so declared or 13 adjudged invalid or unconstitutional was not originally a part of the resolution. 14 Section 5. Repealer.
