3 A RESOLUTION AUTHORIZING USE OF EMINENT DOMAIN ON
4 THE 40TH STREET PROJECT.

6 WHEREAS, attempts to acquire right -of -way necessary for construction of the
7 40'h Street Project have been unsuccessful; and
8 WHEREAS, we will continue to attempt to acquire necessary property.
9 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
10 THE CITY OF LITTLE ROCK ARKANSAS:
11 Section 1. The City Manager is authorized to use eminent domain to complete
12 acquisition of right -of -way for this project.
13 Section 2. Funding for this property is available in account CDBG- C25 -A352
14 Section 3. This resolution shall be in full force and effect from and after its
15 adoption.
