11254• 1 2 RESOLUTION NO. 11,254 3 4 A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A 5 CONTRACT WITH CHARLES MCCOLLUM AS PART OF THE TORNADO 6 DISASTER REBUILD TARGETED NEIGHBORHOOD ENHANCEMENT PLAN 7 TO RENOVATE A SINGLE FAMILY RESIDENCE AT 3112 DR. MARTIN 8 LUTHER KING JR. DRIVE IN THE APPROVED TORNADO DISASTER 9 REBUILD TNEP AREA. 10 11 WHEREAS, the City has been granted authority to contract with owners of property to 12 agree to live in residential dwellings in targeted neighborhoods for a period of five (5) years, 13 and to use the consideration for such agreements to construct or rehabilitate residential 14 structures in an effort to recapture or rehabilitate neighborhoods that have become urban 15 blight, or that could become an area of blight if such actions are not taken, and 16 WHEREAS, pursuant to the authority of Act 320 of 1997 (codified as Ark. Code Ann. §§ 17 14- 169 -1101 to 1108 (Michie Repl. 1998), as may be amended) (hereinafter referred to as "the 18 Act "), the City Board of Directors has completed the process and determined that this area in 19 the City qualifies as a targeted neighborhood as defined by the Act, and 20 WHEREAS, after fulfillment of the statutory requirements to do so, the City adopted 21 Little Rock, Ark., Ordinance No. 18,387 (November 14, 2000), and designated this portion of 22 the City as the Tornado Area Disaster Rebuild Targeted Neighborhood Enhancement Plan area 23 (hereinafter referred to as the "Tornado Area TNEP "), and 24 WHEREAS, the Owner, Charles McCollum, has submitted an appropriate application to 25 contract with the City to provide an owner occupied residential structure within the boundaries 26 of the Tornado Area TNEP in the amount of FOURTEEN THOUSAND THREE HUNDRED 27 EIGHTY -TWO DOLLARS ($14,382), and 28 WHEREAS, the City desires to contract with the Owner pursuant to the Tornado Area 29 TNEP program, and the Owner desires to assure the residency requirements of the TNEP 30 program are met so this neighborhood can be recaptured and a meaningful residential area can 31 be developed, McCollum TNEP Resolution Page 1 of 1 1 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE 2 CITY OF LITTLE ROCK ARKANSAS: 3 Section 1. The City Manager is authorized to execute a contract with Charles McCollum 4 for the renovation of the residence at 3112 Dr. Martin Luther King Jr. Drive in the approved 5 Tornado Area TNEP. 6 Section 2. This action authorizes a $14,382.00 contract between the City of Little Rock 7 and Charles McCollum to support renovation activities at 3112 Dr. Martin Luther King Jr. Drive 8 in the Tornado Area TNEP. 9 Section 3. Severabi/ity. In the event any title, section, paragraph, item, sentence, 10 clause, phrase, or word of this resolution is declared or adjudged to be invalid or 11 unconstitutional, such declaration or adjudication shall not affect the remaining portions of the 12 resolution which shall remain in full force and effect as if the portion so declared or adjudged 13 invalid or unconstitutional was not originally a part of the resolution. 14 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that 15 are inconsistent with the provisions of this resolution are hereby repealed to the extent of such 16 inconsistency. 17 Section S.
