11252s s 1 RESOLUTION NO. 11,25 2 3 A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A 4 CONTRACT WITH FRED NELSON AND LYNETTE NELSON AS PART OF 5 THE TORNADO DISASTER REBUILD TARGETED NEIGHBORHOOD 6 ENHANCEMENT PLAN TO RENOVATE A SINGLE FAMILY RESIDENCE AT 7 524 EAST 17TH STREET IN THE APPROVED TORNADO DISASTER 8 REBUILD TNEP AREA. 9 10 WHEREAS, the City has been granted authority to contract with owners of property to 11 agree to live in residential dwellings in targeted neighborhoods for a period of five (5) years, 12 and to use the consideration for such agreements to construct or rehabilitate residential 13 structures in an effort to recapture or rehabilitate neighborhoods that have become urban 14 blight, or that could become an area of blight if such actions are not taken, and 15 WHEREAS, pursuant to the authority of Act 320 of 1997 (codified as Ark. Code Ann. §§ 16 14- 169 -1101 to 1108 (Michie Repl. 1998), as may be amended) (hereinafter referred to as "the 17 Act "), the City Board of Directors has completed the process and determined that this area in 18 the City qualifies as a targeted neighborhood as defined by the Act, and 19 WHEREAS, after fulfillment of the statutory requirements to do so, the City adopted 20 Little Rock, Ark., Ordinance No. 18,387 (November 14, 2000), and designated this portion of 21 the City as the Tornado Area Disaster Rebuild Targeted Neighborhood Enhancement Plan area 22 (hereinafter referred to as the "Tornado Area TNEP "), and 23 WHEREAS, the Owner, Fred Nelson and Lynette Nelson, has submitted an appropriate 24 application to contract with the City to provide an owner occupied residential structure within 25 the boundaries of the Tornado Area TNEP in the amount of TWENTY THOUSAND FIVE 26 HUNDRED FIFTEEN DOLLARS ($20,515.00), and 27 WHEREAS, the City desires to contract with the Owner pursuant to the Tornado Area 28 TNEP program, and the Owner desires to assure the residency requirements of the TNEP 29 program are met so this neighborhood can be recaptured and a meaningful residential area can 30 be developed, 31 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE 32 CITY OF LITTLE ROCK ARKANSAS: 33 Section 1. The City Manager is authorized to execute a contract with Fred Nelson and 34 Lynette Nelson for the renovation of the residence at 524 East 17"' Street in the approved 35 Tornado Area TNEP. 1 Section 2. This action authorizes a $20,515 contract between the City of Little Rock 2 and Fred Nelson and Lynette Nelson to support renovation activities at 524 East 17u' Street in 3 the Tornado Area TNEP. 4 Section 3. Severability. In the event any title, section, paragraph, item, sentence, 5 clause, phrase, or word of this resolution is declared or adjudged to be invalid or 6 unconstitutional, such declaration or adjudication shall not affect the remaining portions of the 7 resolution which shall remain in full force and effect as if the portion so declared or adjudged 8 invalid or unconstitutional was not originally a part of the resolution. 9 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are 10 inconsistent with the provisions of this resolution are hereby repealed to the extent of such 11 inconsistency. 12 Section 5.
