11229Q U W ENE c1pr 101 2662119722 °,. 82/27/2882 10:37:53 AN Filed & Recorded in •* n e Official Records of aP •'•� %t' ^ p e CAROLYN STALEY i '� • • C a RESOLUTION NO. 11.229 PULASKI COUNTY ' g CIRCUIT /COUNTY CLERK y o Fees $11.80 P°° /ryY�y, SOLUTION TO AUTHORIZE THE PURCHASE OF A TRACT OF °"Whi(Y,cuo °o °° 4 °PROPERTY ADJACENT TO THE WILLIAM JEFFERSON CLINTON 5 PRESIDENTIAL PARK; TO AUTHORIZE THE MAYOR AND CITY CLERK 6 TO EXECUTE ANY NECESSARY DOCUMENTS TO EFFECT THIS 7 PURCHASE; AND FOR OTHER PURPOSES. 8 9 WHEREAS, the City Board of Directors adopted Little Rock, Ark., Resolution No. 10,125 10 (November 7, 1997) ( "LRR_" ),.to create the William Jefferson Clinton Presidential Park District 11 ("Clinton Presidential Park "), and 12 WHEREAS, pursuant to Little Rock, Ark., Ordinance No. 17,690 (March 17, 1998) 13 ( "LRO_ ") the City issued capital improvement revenue bonds, authorized by Amendment 65 to 14 the Arkansas Constitution, and the proceeds from this bond issue included monies to pay for land 15 acquisition for the Clinton Presidential Park, and 16 WHEREAS, this land acquisition included the purchase of certain railroad right -of -way and 17 railroad bridges as expressly authorized in LRR 11,173 (December 4, 2001), and 18 WHEREAS, with the accumulation of land for the Clinton Presidential Park, and the 19 railroad right -of -way and bridges, it has been determined that there is a small plot of land 20 immediately adjacent to the park that should be purchased in order to preserve the park environment 21 and funds are available for this purchase in the bond proceed fund, and 22 WHEREAS, this purchase would be consistent with the goals set forth in the Little Rock 23 Parks & Recreation Master Plan approved in LRO 18,528 (July 17, 2001), 24 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF 25 THE CITY OF LITTLE ROCK, ARKANSAS: 26 Section 1. The Mayor and City Clerk are authorized to execute any and all documents to 27 effect the transfer of title of certain property more fully described in Exhibit A to this Resolution to 28 the City of Little Rock, Arkansas, for an amount not to exceed fifty thousand ($50,000) dollars. Funds for this purchase are available from the $16,405,000, City of Little 2 Rock, Arkansas, Capital Improvement Revenue Bonds: Parks & Recreation Purposes, Series 3 1998A, and are found in Account No. 305- 214 -A105. 4 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, 5 phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such 6 declaration or adjudication shall not affect the remaining portions of the resolution which shall 7 remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional 8 was not originally a part of the resolution. 9 Section 4. Repealer.
