3 A RESOLUTION TO AUTHORIZE A CONTRACT WITH GENESIS
4 ENVIRONMENTAL CONSULTING, INC., TO PROVIDE QUALITY
5 ASSURANCE SERVICES FOR THE CONSTRUCTION OF CELL 4 OF THE
6 CITY CLASS I LANDFILL; AND FOR OTHER PURPOSES.

8 WHEREAS, in 1993 the Board of Directors of the City of Little Rock, Arkansas,
9 authorized the issuance of $16,870,000 City of Little Rock, Arkansas, Waste Disposal
to Revenue Bonds (Series 1993), in Little Rock, Ark., Ordinance No. 16,409 (April 20, 1993), in
11 order to finance construction of a sanitary landfill that would meet state and federal
12 environmental regulations, and
13 WHEREAS, in 1995 the Board of Directors authorized the issuance of $11,900,000
14 City of Little Rock, Arkansas, Waste Disposal Revenue Bonds (Series 1995), pursuant to
15 Little Rock, Ark., Ordinance No. 17,036 (December 5, 1995), in order to finance various
16 extensions, betterments and improvements to the City solid waste disposal system, and
17 WHEREAS, in Little Rock, Ark., Resolution No. 11,171 (December 4, 2001), the
18 Board of Directors stated its intent to issue up to $12,300,000 in new waste disposal
19 improvement bonds to fund the cost of the creation of a new cell at the City landfill, and to
20 purchase certain disposal and collection equipment, and
21 WHEREAS, the City needs to begin construction on the new cell of the landfill as
22 soon as possible, and in doing so needs the services of a qualified environmental engineer
23 to assure continued compliance with state and federal environmental regulations, and

1 WHEREAS, pursuant to RFQ No. 01352 was sent to 103 firms and was also
2 published on November 26, 2001, and in response the City received four qualified
3 proposals, and
4 WHEREAS, it was determined that Genesis Environmental Consulting, Inc., was
5 the most qualified engineering firm to provide this service, and a contract in the amount of
6 $202,809.00 was negotiated between the parties in accordance with state law, and
7 WHEREAS, because the City adopted Little Rock, Ark., Resolution 11,171
8 (December 4, 2001), it can, pursuant to United States Treasury Department Regulation NO.
9 1.150 -2, be reimbursed for the cost of this quality assurance contract from the proceeds of
10 the solid waste revenue bonds once the bonds are actually issued,
11 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
12 THE CITY OF LITTLE ROCK, ARKANSAS:
13 Section 1. The City Manager is authorized to enter into an agreement with
14 Genesis Environmental Consulting, Inc., in an amount not to exceed two hundred and two
15 thousand eight hundred and nine dollars ($202,809.00) to provide quality assurance
16 during the construction of Cell 4 of the City's Class I Landfill.
17 Section 2. Funds for the payment of this contract shall be made available from
18 the proceeds of the Series 2002 solid waste revenue bonds that the City intends to issue
19 pursuant to the statement of intent contained in Little Rock, Ark., Resolution No. 11,171
20 (December 4, 2001).
21 Section 3. Severability. In the event any title, section, paragraph, item, sentence,
22 clause, phrase, or word of this resolution is declared or adjudged to be invalid or
23 unconstitutional, such declaration or adjudication shall not affect the remaining portions

1 of the resolution which shall remain in full force and effect as if the portion so declared or
2 adjudged invalid or unconstitutional was not originally a part of the resolution.
3 Section 4. Repealer. All resolutions, bylaws, and other matters inconsistent with
4 this resolution are hereby repealed to the extent of such inconsistency.
