A RESOLUTION TO AUTHORIZE A WATERLINE
EASEMENT LEASE AGREEMENT WITH SHOLLMIER
FAMILY TRUST, LLC., AND FOR OTHER PURPOSES
WHEREAS, Central Arkansas Water has a franchise agreement with the City of Little
Rock for certain City Rights -of- Ways.
WHEREAS, Shollmier Family Trust, LLC submitted a proposal for lease of a 20
Foot wide easement for water service of lands lying in Section 17 & 18, Township 2
North, Range 13 West, City of Little Rock, Pulaski County, Arkansas.
WHEREAS, an appropriate fee has been negotiated for this limited use of this portion of
park property.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
Section 1. The appropriate City officials, including but not limited to the Mayor, City
Manager and City Clerk, are authorized to execute documents which would grant a
waterline easement to Shollmier Family Trust, LLC, provided the legal form of such
easement is approved by the Office of the City Attorney.
Section 2. Severability. In the event of any tile, section, paragraph, item, sentence,
clause, phrase, or word of this resolution is declared or adjudged to be invalid or
unconstitutional, such declaration or adjudication shall not affect the remaining portions
of the resolution which shall remain in full force and effect as if the portion so declared
or adjudged invalid or unconstitutional was not originally a part of the resolution.
Section3. Repealer. All laws, ordinances, resolutions or parts of the same, that are
inconsistent with the provision of this resolution are hereby repealed to the extent of such
