111400 0 1 RESOLUTION NO. 11.140 2 3 A RESOLUTION TO SET NOVEMBER 6, 2001, AS THE DATE OF 4 HEARING ON A PETITION TO ABANDON A PORTION OF 5 FOLSOM STREET (ALSO KNOWN AS "FOSTER STREET "), 6 ABELES STREET, GREGG STREET (ALSO KNOWN AS "WALSH 7 STREET" OR "WASH STREET "), EAST 7TH STREET, EAST 8TH 8 STREET, EAST 9TH STREET AND EAST 10TH STREET FOR A 9 RUNWAY EXTENSION PROJECT FOR LITTLE ROCK REGIONAL 10 AIRPORT; AND FOR OTHER PURPOSES. 12 WHEREAS, a petition was duly filed with the Board of Directors of the City 13 of Little Rock, Arkansas, on the 161h day of October 2001, asking the Board of 14 Directors to vacate and abandon a portion of right -of -way pursuant to Ark. Code 15 Ann. Sec. 14 -54 -104 (Michie Repl. 1998) since the property is no longer needed for 16 basic corporate purposes, but is now needed for runway extension purposes for the 17 Little Rock Regional Airport, and 18 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS 19 OF THE CITY OF LITTLE ROCK, ARKANSAS: 20 Section 1. The Board of Directors sets November 6, 2001, at 6:00 PM in the 21 Board meeting room on the second floor of City Hall, 500 West Markham, Little 22 Rock, Arkansas, as the time and place for a public hearing on the question of 23 whether to abandon public right -of -way more fully described below, pursuant to 24 Ark. Code Ann. § 14 -54 -104 (Michie Repl. 1998), because such right -of -way is no 31 [PAGE 1 OF 5] 0 0 i longer needed for basic corporate purposes, but is now needed as part of a runway 2 extension project for the Little Rock Regional Airport: 3 (a) The first parcel of property is more fully described as follows: 4 East 7th Street 5 Closure of E. 71h Street between the East right -of -way line of Folsom 6 Street and the East end of E. Th Street, also described as bounded on 7 the west by the west line of Lot 1, Block H, Harrington's 3rd Industrial 8 Addition, and the west line of Lot 12, Block C, Harrington's 3rd 9 Industrial Addition; and bounded on the east by the east line of Lot 1, 10 Block F, Harrington's 3rd Industrial Addition, and the east line of Lot 11 12, Block E, Harrington's 3rd Industrial Addition. 12 (b) The second parcel of property is more fully described as follows: 13 East 8th Street 14 Closure of E. 8th Street between the East right -of -way line of 15 Harrington Street and the West right -of -way line of Folsom Street, also 16 described as bounded on the west by the west line of Lot 13, Block 4, 17 Harrington's Industrial Addition and the west line of Lot 24, Block 5, 18 Harrington's Industrial Addition; and bounded on the east by the east 19 line of Lot 12, Block 4, Harrington's Industrial Addition, and the east 20 line of Lot 1, Block 5, Harrington's Industrial Addition. 21 (c) The third parcel of property is more fully described as follows: 22 East 91h Street 23 Closure of E. 91h Street from the center of the block between Harrington 24 Street and Folsom Street, to the center of the block between Gregg 25 Street and Corning Street, also described as bounded on the west by [PAGE 2 OF 51 0 0 1 the west line of Lot 12, Block 5, Harrington's Industrial Addition, and 2 the west line of Lot 1, Block 8, Harrington's Industrial Addition; and 3 bounded on the east by the east line of Lot 1, Block 6, Harrington's 2nd 4 Industrial Addition, and the east line of Lot 8, Block 5, Harrington's 2nd 5 Industrial Addition. 6 (d) The fourth parcel of property is more fully described as follows: 7 East 10t" Street 8 Closure of E 101h Street from the center of the block between 9 Harrington Street and Folsom Street, to the West right -of -way line of 10 Corning Street, also described as bounded on the west and to the north 11 by the west line of Lot 12, Block 8, Harrington Industrial Addition, and 12 to the south by Little Rock National Airport property; and bounded on 13 the east by the east line of Lot 6, Block 5, Industrial Park Addition, and 14 the east line of Lot A, Industrial Park Addition. 15 (e) The fifth parcel of property is more fully described as follows: 16 Folsom Street (a /k /a "Foster Street ") 17 Closure of Folsom Street between the South right -of -way line of E. 7th 18 Street and the North right -of -way line of E. 101h Street, also described as 19 bounded on the north by the north line of Lot 1, Block B, Harrington's 20 3rd Industrial Addition, and the north line of Lot 12, Block C, 21 Harrington's 3rd Industrial Addition, and bounded on the south by the 22 south line of Lot 12, Block 8, Harrington's Industrial Addition, and the 23 south line of Lot 1, Block 1, Harrington's 2nd Industrial Addition. 24 (f) The sixth parcel of property is more fully described as follows: [PAGE 3 OF 51 0 0 1 Abeles Street 2 Closure of Abeles Street from 45.1 feet north of the North right -of -way 3 line of E. Th Street to the North right -of -way line of E. 101h Street, also 4 described as bounded on the north by the north line of Lot 6, Block H, 5 Harrington's 3rd Industrial Addition, and the north line of Lot 1, Block 6 G, Harrington's 3rd Industrial Addition, and bounded on the south by 7 the south line of Lot 9, Block 1, Harrington's 2nd Industrial Addition, 8 and the south line of Lot 1, Block 3, Harrington's 2nd Industrial 9 Addition. 10 (g) The seventh parcel of property is more fully described as follows: 11 Gregg Street (a /k /a "Walsh Street" or "Wash Street ") 12 Closure of Gregg Street from 45.1 feet north of the North right -of -way 13 line of E. 7th Street to the North right -of -way line of E. 101h Street, also 14 describe as bounded on the north by the north tine of Lot 6, Block G, 15 Harrington's 3rd Industrial Addition, and the north line of Lot 1, Block 16 F, Harrington's 3rd Industrial Addition, and bounded on the south by 17 the south line of Lot 9, Block 3, Harrington's 2nd Industrial Addition, 18 and the south line of Lot 1, Block 5, Harrington's 2nd Industrial 19 Addition. 20 Section 2. Such closures as described to be subject, however, to an 21 easement for public utilities and drainage to the extent that such easements are 22 compatible with the operations at Little Rock National Airport and do not interfere 23 with Petitioner's ability to comply with all state and federal regulations applicable 24 to Little Rock National Airport. The City Clerk is hereby directed to give notice of such hearing 2 in the manner prescribed by law by publication once a week for two (2) consecutive 3 weeks in a newspaper published in Pulaski County, Arkansas, and having general 4 circulation in City of Little Rock. 5 Section 4. Severability. In the event any title, section, paragraph, item, 6 sentence, clause, phrase, or word of this resolution is declared or adjudged to be 7 invalid or unconstitutional, such declaration or adjudication shall not affect the 8 remaining portions of the resolution which shall remain in full force and effect as if 9 the portion so declared or adjudged invalid or unconstitutional was not originally a 10 part of the resolution. 11 Section 5. Repealer.
