11128I SOLUTION NO. 11,128 0 3 A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A 4 CONTRACT WITH TINA SMITH AS PART OF THE TORNADO DISASTER 5 REBUILD TARGETED NEIGHBORHOOD ENHANCEMENT PLAN TO 6 RENOVATE A SINGLE FAMILY RESIDENCE AT 2710 BISHOP STREET IN 7 THE APPROVED TORNADO DISASTER REBUILD TNEP AREA. 8 9 WHEREAS, the City has been granted authority to contract with owners of property to 10 agree to live in residential dwellings in targeted neighborhoods for a period of five (5) years, and to 11 use the consideration for such agreements to construct or rehabilitate residential structures in an 12 effort to recapture or rehabilitate neighborhoods that have become urban blight, or that could 13 become an area of blight if such actions are not taken, and 14 WHEREAS, pursuant to the authority of Act 320 of 1997 (codified as Ark. Code Ann. §§ 14- 15 169 -1101 to 1108 (Michie Repl. 1998), as may be amended) (hereinafter referred to as "the Act'), the 16 City Board of Directors has completed the process and determined that this area in the City qualifies 17 as a targeted neighborhood as defined by the Act, and 18 WHEREAS, after fulfillment of the statutory requirements to do so, the City adopted Little 19 Rock, Ark., Ordinance No. 18,387 (November 14, 2000), and designated this portion of the City as 20 the Tornado Area Disaster Rebuild Targeted Neighborhood Enhancement Plan area (hereinafter 21 referred to as the " Tornado Area TNEP "), and 22 WHEREAS, the Owner, Tina Smith, has submitted an appropriate application to contract 23 with the City to provide an owner occupied residential structure within the boundaries of the 24 Tornado Area TNEP in the amount of SIX THOUSAND THREE HUNDRED EIGHT 25 DOLLARS ($6,308.00), and 26 WHEREAS, the City desires to contract with the Owner pursuant to the Tornado Area 27 TNEP program, and the Owner desires to assure the residency requirements of the TNEP program 28 are met so this neighborhood can be recaptured and a meaningful residential area can be developed, 29 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE 30 CITY OF LITTLE ROCK ARKANSAS: 31 Section 1. The City Manager is authorized to execute a contract with Tina Smith for the 32 renovation of the residence at 2710 Bishop Street in the approved Tornado Area TNEP. 33 Section 2. This action authorizes a $6,308.00 contract between the City of Little Rock and 34 Tina Smith to support renovation activities at 2710 Bishop Street in the Tornado Area TNEP. 35 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, 36 phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such I declaration or adjudication RS H not affect the remaining portio of the resolution which shall 2 remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional 3 was not originally a part of the resolution. 4 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are 5 inconsistent with the provisions of this resolution are hereby repealed to the extent of such 6 inconsistency. 7 Section 5.
