110510 0 RESOLUTION NO. 11.051 A RESOLUTION TO AUTHORIZE THE PUBLIC WORKS DEPARTMENT TO PERFORM CITY YARD WASTE COMPOST; AND FOR OTHER PURPOSES. WHEREAS, Arkansas law requires that the City provide some type of service for the collection and compost of yard waste within the City, and that such material not simply be placed in the City's sanitary landfill, and WHEREAS, the City has maintained a contract with a private contractor to provide compost services to the City, and this contract will expire on June 24, 2001, and WHEREAS, after a competitive bid process, for which the City submitted a bid to see how its proposed cost to handle this service internally compared to private contractual costs, and WHEREAS, the City was the only entity to submit a bid, but with the addition of certain personnel and the purchase of certain equipment the City Manager is comfortable that the Public Works Department can provide this service to the citizens in a cost effective manner, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The City Manager is authorized to require that the Public Works Department become responsible for the collection and composting of yard waste from addresses within the corporate limits of the City. Section 2. To the extent that additional personnel will be required to fulfill the City's obligations for this service, particularly when the current contract expires on June 24, 2001, and to the extent that additional equipment will need to be purchased to assist with this effort, the City Manager is directed to identify such costs and to provide for the expenditures as may be required including, but not limited to, an amendment to the current City budget ordinance, and the provision of expenditures in future City budget ordinances. 7 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the resolution. Section 5. Repealer. All laws and parts of laws are hereby repealed to the extent of such inconsistency.
