109151 `a 0 • RESOLUTION NO. 10,91 3 A RESOLUTION TO AUTHORIZE A LEASE WITH THE 4 UNIVERSITY OF ARKANSAS AT LITTLE ROCK OF THE 5 BASEBALL FACII.ITIES IN CURRAN CONWAY PARK; AND FOR 6 OTHER PURPOSES. 7 8 WHEREAS, in 1986 the City entered into an agreement with former Trojan 9 baseball coach and athletic director Gary Hogan of the University of Arkansas at Little 10 Rock ( "UALR "), to lease the baseball facilities in Curran Conway Park to the UALR 11 for use by its NCAA Division I college baseball program, and 12 WHEREAS, this relationship has been extremely beneficial to the City, the 13 neighborhoods surrounding Curran Conway Park, and to UALR, and 14 WHEREAS, UALR recently had a benefactor donate $200,000, to the program 15 for the upgrade of the baseball facility, and 16 WHEREAS, the dedication of UALR to the community around the University 17 is marked by its response to the City's bid package to lease this facility under terms that 18 are in the best interests of the City which, among other things, noted that the submission 19 was "part of UALR's larger commitment to the neighborhood in which it is located, and 20 WHEREAS, the City wishes to maintain this excellent and mutually beneficial 21 relationship, 22 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF 23 DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: 24 Section 1. The City Manager is authorized to enter into a lease agreement with 25 the University of Arkansas at Little Rock, in a form approved by the City Attorney, for 26 a period of not more than twenty (20) years, for the use of the baseball facilities and 27 surrounding properties in Curran Conway Park by the University's baseball team and 28 athletic program. i • 1 Section 2. The City finds that the proposal submitted by the University in 2 response to RFP # 00339 for this park property is the highest responsible bid, and is one 3 that is in the best interests of the citizens of the City of Little Rock. 4 Section 3. Severability. In the event any title, section, paragraph, item, 5 sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid 6 or unconstitutional, such declaration or adjudication shall not affect the remaining 7 portions of the resolution which shall remain in full force and effect as if the portion so 8 declared or adjudged invalid or unconstitutional was not originally a part of the 9 resolution. 10 Section 4. Repealer.
