10905RESOLUTION NO. 10 , 90 A RESOLUTION AUTHORIZING THE MAYOR AND THE CITY CLERK TO EXECUTE AN AMENDMENT TO THE BILL OF ASSURANCE OF THE LITTLE ROCK PORT INDUSTRIAL PARK TO EXEMPT AREA 300 FROM AMENDMENT FOUR, ARTICLE SEVEN "OUTSIDE STORAGE". WHEREAS, the Board of Commissioners of the Little Rock Port Authority have voted to amend its Bill of Assurance to exempt Area 300 from the "Outside Storage "(article seven) and allow tenants of the Port in Area 300 to store goods, equipment, supplies or other materials in the open on the front one - fourth (1/4) of said property: and WHEREAS, the Little Rock Board of Directors finds that such amendment of the Bill of Assurance is appropriate for the port to allow storage on this additional acreage. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1: The Mayor and City Clerk are authorized to execute an Amendment of Bill of Assurance of the Little Rock Port Industrial Park to allow tenants in Area 300 to store products on the front one -fourth (1/4) of their property, in substantially the form of the amendment of Bill of Assurance attached hereto as Exhibit "A" subject to approval of the City Attorney. Carpenter, Ciq Attorney APPROVED: �(y im Daiiey, Mayor jf 0 0 LITTLE ROCK PORT INDUSTRIAL PARK AMENDMENT OF BILL OF ASSURANCE WHEREAS, the City of Little Rock, Arkansas, a municipal corporation (the "City") is the owner of more than fifty -one percent (51%) of the area of land within the Little Rock Port Industrial Park (the "Port") described in that certain original Bill of Assurance dated December 16, 1971, and recorded December 16, 1971 in the records of the Circuit Clerk and Ex -officio Recorder of Pulaski County, Arkansas, in Record book 1175 at page 543 (the "Bill of Assurance ") as subsequently amended and as amended herein; and WHEREAS, paragraph 7 of the Amended Bill of Assurance entitled "Outside Storage" provided that in no area would goods, equipment, supplies or other materials be stored in the open except on the rear three - fourths (3/4) of the property; and WHEREAS, the City deems it necessary to amend the provision to allow storage on the front section of the tracts in Area 300; and WHEREAS, the undersigned being the owners of at lease fifty -one percent (51 %) of the area of the land within the Port as described in the Bill of Assurance have the authority to make this amendment. NOW, THEREFORE, WITNESS: 1. That paragraph 7 entitled "Outside Storage" of the Bill of Assurance is hereby deleted in its entirety, and the following language shall be substituted therefore: 7. Outside Storage. In all areas, except area 300, of the Little Rock Industrial Park, as originally platted or subsequently replatted, no goods, equipment, supplies or other material shall be stored in the open except on the rear three - fourths (3/4) of said property. 2. Except as amended hereby, all the remaining provisions of the Bill of Assurance are valid and in full force and effect.
