10345M M = = M = M M = M = � M u am I RESOLUTION NO. 10,345 3 A RESOLUTION AGAINST THE PROPOSED AMENDMENT TO a ABOLISH AD VALOREM PROPERTY TAXES; AND FOR s OTHER PURPOSES. 6 7 s WHEREAS, an initiative effort to propose a constitutional amendment which 9 purports to abolish all ad valorem property taxes has been circulated and has received io sufficient signatures to be placed upon the November, 1998, election ballot, and I I WHEREAS, this proposed amendment not only abolish ad valorem property taxes, 12 but also has other potentially catastrophic consequences for the citizens of the City of 13 Little Rock, Arkansas, and is WHEREAS, these consequences include the failure to fund the police and fire 15 pension funds, or to adequately fund the operation of the Central Arkansas Library 16 System, or to adequately fund the Little Rock School District and the Pulaski County 17 Special School District, and is WHEREAS, the proposal to replace this ad valorem property tax with a two percent iv (2 %) sales tax, if and only if such taxation is approved by the General Assembly and the 20 voters, would create havoc for the efficient administration of city services since there is 21 no guarantee the General Assembly would pass such a bill, or if it did, whether the voters 22 would approve such a tax, and 23 WHEREAS, such a situation makes it impossible to plan for the operation of 24 government, or even to assure that essential services are provided to the citizens, 25 particularly in light of the fact that this proposed two percent (2 %) sales and 26 compensating use tax does not replace the revenues lost by the ad valorem property tax, 27 and 28 WHEREAS, the proposed amendment also eliminates the ability of the state or the 29 City to impose any regulation, even in environmental matters, if that regulation is deemed 30 harmful to business, and such a situation would mean, for example, that despite the 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 • 418 City's best efforts a medical waste incinerator could locate next to a residential area, or a sexually oriented business could locate wherever it liked within the City, and WHEREAS, for all of these reasons, the Board of Directors of the City of Little Rock, Arkansas, believes that this constitutional amendment is not in the best interests of the citizens of Little Rock, nor of the citizens of the State of Arkansas, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1: The Board is opposed to the initiated constitutional amendment to abolish ad valorem property taxes within the State of Arkansas, and encourages the citizens of the City of Little Rock, Arkansas, to vote against this measure.
