A RESOLUTION TO AUTHORIZE AN INCREASE IN
THE PAYMENT TO THE LAW FIRM OF CROSS,
GUNTER, WITHERSPOON & GALCHUS FOR WORK
BEFORE THE LITTLE ROCK CIVIL SERVICE
COMMISSION; AND FOR OTHER PURPOSES.
WHEREAS, after a competitive selection process, the law firm of Cross, Gunter,
Witherspoon & Galchus was selected to present management's case before the Little Rock Civil
Service Commission because state law requires a separate lawyer than the City Attorney, and
WHEREAS, the contract negotiated set a $20,000 maximum fee for such legal work
unless prior to incurring additional expense the Board of Directors, after a public hearing, voted
to increase the funding, and
WHEREAS, in 1997 there were some exceptionally difficult appeals and the law firm
exceeded the maximum fee by $17, 507.50, but failed to request additional funds in advance
as required by the contract, and
WHEREAS, the billings have been reviewed by the Department of Human Resources
and by the City Attorney's office and, under the circumstances, have been deemed to be
reasonable,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. For calendar year 1997 only the legal services contract with the law firm
of Cross, Gunter, Witherspoon & Galchus is amended to provide an additional to annual
consideration by seventeen thousand five hundred and seven dollars and fifty cents
($17,507.50).
SECTION 2. The funds for this payment shall come from Account No. 100.350.5600-
6081.
