A RESOLUTION EXPRESSING THE OPPOSITION OF THE
BOARD OF DIRECTORS OF THE CITY OF LITTLE

ROCK, ARKANSAS, TO AN APPLICATION FOR A
6
PERMIT TO BFI, INC., TO OPERATE AN EXPANDED
7
SOLID WASTE DISPOSAL FACILITY; AND FOR OTHER
8
PURPOSES.

WHEREAS, in 1989, BFI, Inc., initially requested a permit
10
from the Arkansas Department of Pollution Control and Ecology
11
(DPC &E) to expand.a solid waste disposal site, and
12
WHEREAS, this Board could favor such a permit only if
13
certain conditions were met, and
WHEREAS, it is the finding of this Board that these
14
conditions have not been met in that there has been a
15
contamination of ground water, and there have been flooding
16
problems, and
17
WHEREAS,. there is pending before DPC &E an application for
18
an expanded permit which the City believes should be denied in
accordance with Arkansas law, and
19
WHEREAS, the City takes this position with the belief that
20
it is necessary to do so to protect the public health, safety
21
and welfare,'and, in addition, that such a stance is authorized
22
by Act 1263 of 1993 of the Arkansas General Assembly,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
23
THE CITY OF LITTLE ROCK, ARKANSAS:

Section 1. The City of Little Rock, acting through its duly
25
elected Mayor and Members of the Board of Directors, goes on
26
record as being opposed to the grant of a permit for the
.27
expanded operation of a solid waste disposal facility by BFI,
Inc., as outlined in CSN Identification No. 60 -0656, Permit No.
28
151- S1 -R3, presently pending before the State of Arkansas
29
Department of Pollution Control and Ecology.
