3 A RESOLUTION AUTHORIZING THE WEST
4 HIGHWAY 10 SUBURBAN WATER
5 IMPROVEMENT DISTRICT NO. 344 OF
6 PULASKI COUNTY, ARKANSAS TO CONNECT
7 A SANITARY WATER WORKS DISTRIBUTION
SYSTEM CONSTRUCTED BY THE DISTRICT
8 TO THE LITTLE ROCK WATER WORKS
9 SYSTEM; AND DECLARING AN EMERGENCY.

11 WHEREAS, West Highway 10 Suburban Water Improvement
12 District No. 344 of Pulaski County, Arkansas (the "District")
was duly established as a suburban water improvement district
13 June 13, 1995, by order of Pulaski County Judge Buddy Villines,
14 assigned No. 95 -185 and recorded in Book 95 at Page 308; and
15 WHEREAS, as a suburban improvement district desiring to
16 connect its sanitary water distribution system to the Little
17 Rock Water Works system, the District, as a prerequisite
thereto, now petitions the City of Little Rock for permission to
18 connect its water distribution system to the City's water
19 distribution system; and
20 WHEREAS, after due notice as required by law, the Board of
21 Directors of the City of Little Rock has heard all parties
desiring to be heard and having ascertained that the District is
22 duly established pursuant to law has resolved as follows.
23 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
24 THE CITY OF LITTLE ROCK, ARKANSAS:
25 SECTION 1. The establishment of the District for the
26 purposes stated in the Order so establishing the District is
hereby recognized and the District is authorized to connect its
27 sanitary water distribution lines to the Little Rock Water Works
28 system for the purposes stated in the Order forming the District
29 subject to the following:
30 A. The point of connection, the plans and
31 specifications and the infrastructure for
the District's sanitary water
32 distribution system to be constructed
33 shall be first approved by the Little
34 Rock Water Works Department; and
35 B. No property located outside the City
36 limits will be permitted to tie onto the

Little Rock Water Works system until
those properties are annexed into the
City of Little Rock or a pre- annexation
agreement has been executed for such
properties.
SECTION 2. There is hereby declared to be an emergency in
that there is an immediate need for the construction of the
District's water system for the promotion and the protection of
the health, safety and welfare of the citizens of Little Rock,
Arkansas, and this resolution shall be in full force and effect
from and after its passage.
