PROGRAM DESCRIPTION TO THE
DEPART24ENT OF HOUSING AND URBAN
DEVELOPMENT (HUD) PURSUANT TO
RECEIVING HOME INVESTMENT
PARTNERSHIP PROGRAM FUNDING.
WHEREAS, the City of Little Rock is entitled to receive
federal HOME Investment Partnership Program funds from the
Department of Housing and Urban Development; and
WHEREAS, HOME funds are intended for use to promote and
develop affordable housing activities for very low and low
income persons; and
WHEREAS, this is the City's third year of participation in
the HOME Program by the CDBG and Housing Division of the
Department of Neighborhoods and Planning; and
WHEREAS, the HOME allocation for 1994 is projected to be
$816,000 with the Program year beginning July 1, 1994, and
ending June 30, 1995; and
WHEREAS, regulations require submission of an annual
program description in order to secure HOME Investment
partnership Program funds.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City Manager is hereby authorized to submit
the HOME Program description outline (attached hereto as Exhibit
°A") to the Department of Housing and Urban Development for
review and approval to secure funding for the 1994 HOME
Investment Partnership Program.

EXECUTIVE SUMMARY
The City of Little Rock will be utilizing the HOME Investment
Partnership Program during 1994, the third year of such
participation in the Program. The anticipated 1994 HOME Program
allocation for Little Rock is $816,000. Having gained experience
in implementing the HOME Program, the City is now more adept at
planning and using HOME Program funding to produce the greatest
positive impact on affordable housing for low income persons.
HOME activities which have proven successful over the course of the
past two (2) years include new construction, owner - occupied
rehabilitation, first -time homebuyer assistance, and acquisition of
rental housing for special needs tenants. New construction has
been a particularly valuable tool in our community and will
continue to be utilized in the 1994 Program Year. Owner - occupied
rehabilitation activities have been structured much the same as
rehabilitation programs carried out with Community Development
Block Grant funds. Rehabilitation activities will continue to
receive a high priority in 1994.
First -time homebuyer assistance has proven to be a valuable link in
enabling low income persons to own their own homes. Homeownership
is a key element in the City of Little Rock's housing strategy, and
1994 HOME Program funds will be used to further this goal. The
City is extending its efforts to help low income renters,
particularly those with special needs, who might not have access to
other assistance. It is anticipated that 1994 HOME Program funds
will be allocated to activities benefitting rental households,
including special needs tenants.
Of primary importance to the City of Little Rock is the
revitalization of neighborhoods through Community Housing
Development Organizations (CHDOs) and the affordable housing
projects they plan and implement. 1994 Home Program funds are
intended to empower CHDOs with the funding and self- management
tools required to spur local redevelopment. The City has certified
and funded one (1) CHDO to date, while other potential CHDOs are
continuing to increase their capacity to produce affordable housing
and plan their respective projects.
It should be noted that the 1994 HOME Entitlement amount of
$816,000 will require approximately $173,400 in local matching
funds, either monetary or non - monetary. The City of Little Rock
intends to utilize funds made available by the Little Rock
Residential Housing Facilities Board for this purpose. Any other
eligible matching funds or non - monetary match will be accumulated
as credit toward future match obligations.

PROPOSED USE OP 1994 HOME FUNDS
NEW CONSTRUCTION
The City of Little Rock plans to use approximately $121,200 in 1994
HOME funds for construction of new homes for sale to first time,
low income homebuyers. This expenditure would be matched by
$30,300 in local funds for a total allocation of $151,500. The
investment, when coupled with program income generated from sale of
the houses, will ultimately result in the production of
approximately seven (7) new affordable homes.
Considering new construction to be completed with current Little
Rock Affordable Housing Program funds, staff capacity would be
fully utilized in producing three (3) newly constructed HOME units
during the 1994 HOME Program Year. New construction of the four
(4) remaining affordable homes projected will be undertaken as
units are sold, producing additional program income. It is
anticipated that all new construction to be performed by the City
of Little Rock will be for first time homebuyers. Possible new
construction of rental housing will be undertaken by for - profit or
non - profit entities with competitively- awarded HOME funds.

REHABILITATION

Rehabilitation activity is requested frequently by Little Rock
citizens who need assistance to repair their homes. Because of the
great need for funding to accomplish this activity, the City of
Little Rock intends to allocate $175,000 in 1994 HOME funds to
rehabilitation. It is expected that substantial and moderate
rehabilitation activities performed by the City will primarily
benefit existing homeowners and first time homebuyers, although
rehabilitation of rental units will possibly be undertaken by non-
profit organizations.
Of the $175,000 in HOME funds allocated to rehabilitation
activities, $100,000 will be intended for substantial
rehabilitation projects accompanied by first time homebuyer
assistance. Matching funds (25% or $25,000) will increase this
amount to a total of $125,000. When coupled with program income
realized from the sale of the renovated houses, the HOME investment
of $100,000 should make assistance available for approximately
eight (8) to ten (10) affordable housing units. Provisions have
been made to ensure the affordability of the HOME - assisted units
through HUD - approved resale and recapture guidelines, which are
outlined in a later section of the 1994 HOME Program Description.
Moderate rehabilitation activities undertaken with HOME funds will
be used primarily for owner - occupied residences. During the 1994

HOME Program Year moderate rehabilitation activities will be 242
allocated $75,000 in HOME funds with $18,750 provided in matching
funds. The total of $93,750 will be utilized for rehabilitation
activities to assist low income homeowners with an average subsidy
of $10,000 to $15,000 per unit. Moderate rehabilitation will be
carried out in the format of a leveraged loan, whereby the HOME
subsidy, structured as a deferred payment loan, will leverage funds
borrowed by the owner for the rehabilitation activity. It is
expected that between six (6) and eight (8) low income households
will be assisted by moderate rehabilitation. Any program income
generated from this activity due to the enforcement of HOME resale
provisions or failure to abide by the terms of the deferred payment
loan will be utilized for further moderate rehabilitation.
ACQUISITION
The City of Little Rock plans to use $75,000 in 1994 HOME funds for
acquisition. It is anticipated that acquisition will be used to
assist primarily rental households and first time homebuyers. No
acquisition of existing owner - occupied housing is planned at this
time. One (1) proposed acquisition activity will be assistance
provided to non - profit organizations to acquire structures for use
by special needs clients. Acquisition will also be utilized as
assistance for first time homebuyers who require a financial
subsidy in order to purchase newly constructed or newly
rehabilitated homes. This type of subsidy is intended to be used

chiefly in concentrated areas of redevelopment such as Model Blocks
and in conjunction with CHDO activities. When combined with M3

matching funds in the amount of $18,750, the anticipated HOME
investment of $93,750 for acquisition will assist an estimate of
ten (10) to fifteen (15) affordable housing units.
COMMUNITY HOUSING DEVELOPMENT ORGANIZATIONS
1994 HOME funds will be a primary funding resource for local CHDOs
to undertake affordable housing projects in their respective
neighborhoods. The City of Little Rock intends to make available
to local CHDOs the full fifteen percent (15 %) set aside ($122,400)
as well as the five percent (5$) allocation ($40,800) for operating
expenses. The total of CHDO set aside funds and associated
matching funds is $193,800 and will be utilized to assist
approximately twelve (12) to fifteen (15) housing units, depending
upon the type of assistance chosen by individual CHDOs and the per
unit subsidy required.
It is anticipated that CHDO activities could require larger per
unit subsidies than other HOME - assisted activities in order to
initiate neighborhood revitalization. Greater per unit subsidies
would result in fewer assisted housing units, but additional units
are expected to be completed with program income generated by
various CHDO activities. All program income from CHDO activities
will be utilized to fund additional CHDO projects. Based upon

preliminary information received from CHDO .organizations to date,
the focus of planned CHDO activities is on owner - occupied housing
to initiate local neighborhood revitalization.
NON - PROFIT, FOR - PROFIT HOUSING DEVELOPMENT
The City plans to reserve $200,000 in 1994 HOME funds for use by
various non - profit and for- profit entities for development of
affordable housing. The addition of matching funds in the amount
of $50,000 will result in a small but accessible loan pool of
$250,000 which will serve as a strong incentive to produce
affordable housing. Persons or organizations planning to utilize
HOME funds to develop affordable housing will be required to apply
and compete for HOME funding.
The award of HOME funds will be based on predetermined selection
criteria which will ensure the entities' planned activities address
housing priorities established by the City of Little Rock.
Possible activities are expected to include new construction or
rehabilitation of existing housing, coupled with first time
homebuyer assistance. Other possible projects could be new
construction or rehabilitation of rental property for low income
individuals. While it is difficult to predict the number of units
or persons who would be assisted by these types of activity, it is
anticipated that with an estimated $15,000 subsidy per unit, at
least twenty (20) units of affordable housing would be assisted.

The City of Little Rock plans to use ten percent (10 %) of the 1994
HOME allocation ($81,600) toward costs associated with the
administration of the HOME Program. While actual HOME
administrative costs will exceed this amount, regulations prohibit
using more than ten percent (10 %) of the annual HOME entitlement
for administrative activities. In addition, the City expects to
allocate the full five percent (5 %) of HOME funds ($40,800) allowed
for CHDO operating costs. Again, this amount is not sufficient to
fund all CHDO operating costs, but will be used to defray those
costs to the extent possible.
Since Little Rock has a number of developing CHDOs, the Pulaski
Metropolitan Initiative, an "umbrella" CHDO, was formed to provide
operating assistance to each member CHDO. The twelve (12) member
Board of the Pulaski Metropolitan Initiative (PMI) is composed of
two (2) representatives from each of six (6) participating CHDOs.
It is the intent of the City of Little Rock to provide the five
percent (5 %) HOME CHDO operating allowance to Pulaski Metropolitan
Initiative for maximum benefit to the greatest number of CHDOs.
Following is a tabular summary of proposed activities and
associated funding amounts which will comprise the 1994 HOME

Planned activities such as new construction and rehabilitation
should be implemented within six (6) months of the start of the
1994 HOME Program Year. Because these types of projects are a
continuation of efforts undertaken in prior HOME Program years,
there should be no delay in utilizing HOME funds for new
construction and rehabilitation.
Acquisition activities will be implemented as projects are
developed. First time homebuyer assistance will be utilized on a
continuing basis as homes are produced by new construction or
through projects pairing acquisition with rehabilitation
activities. Acquisition planned in conjunction with non - profit

entities for the provision of rental housing will be undertaken as
those sites are identified and found to be suitable for the 247'
intended clients. CHDO housing activities will be funded and
implemented as those organizations complete their respective
planning processes. A realistic schedule is difficult to project,
but it is anticipated that CHDO activities will be funded and
completed on a continuing basis, allowing CHDOs to implement
affordable housing projects only as their capacities warrant.
The City of Little Rock intends to commit all 1994 HOME funds by
June 30, 1996, and to complete all 1994 projects within twelve (12)
months of fund commitment or by June 30, 1997.
FIRST TIME HOMEBUYER ASSISTANCE - GUIDELINES FOR RESALE /RECAPTURE
The City of Little Rock intends to utilize 1994 HOME Program funds
to offer first time homebuyer assistance to qualified low income
persons. Such assistance is of primary importance to the City's
efforts to increase homeownership and thereby address a current
priority in the Little Rock Comprehensive Housing Affordability
Strategy. Pursuant to HOME regulations governing first time
homebuyer assistance, the following is a summary of the guidelines
for resale or recapture of HOME funds:
All HOME funds used for first time homebuyer assistance will be
secured by a second mortgage on the property as well as a written

agreement between the City and the homebuyer, outlining the resale
or recapture provisions. The second mortgage specifies that upon
any subsequent sale of the property to a non -low income person, the
entire HOME subsidy provided may be declared due and payable or, if
the net proceeds are not sufficient to recapture the entire
subsidy, the entire net proceeds will be due and payable to the
City of Little Rock. Any such funds recaptured will be utilized
for further assistance to other first time, low income homebuyers.
In the case of resale of the property to another low income person
at an affordable price, the City may allow the new buyer to enter
into an agreement and assume the second mortgage for the remainder
of its term. The HOME subsidy will not be due and payable to the
City and will be considered to benefit the new low income first
time homebuyer.

AFFIRMATIVE MARKETING
IN ACCORDANCE WITH THE REGULATIONS OF THE HOME INVESTMENT
PARTNERSHIPS PROGRAM (24 CFR 92.361), AND IN FURTHERANCE OF THE
CITY OF LITTLE ROCK'S COMMITMENT TO NON - DISCRIMINATION AND EQUAL
OPPORTUNITY IN HOUSING, THE CITY OF LITTLE ROCK HAS ESTABLISHED
PROCEDURES TO MARKET AFFIRMATIVELY UNITS MADE AVAILABLE FOR RENT
OR PURCHASE WITH HOME INVESTMENT PARTNERSHIPS FUNDING. THESE
PROCEDURES ARE INTENDED TO FURTHER THE OBJECTIVES OF TITLE VIII
OF THE CIVIL RIGHTS ACT OF 1968 AS AMENDED BY THE FAIR HOUSING
ACT, EXECUTIVE ORDER 11063, AND ALL OTHER APPLICABLE
FAIR HOUSING LAWS.
THE CITY OF LITTLE ROCK BELIEVES THAT INDIVIDUALS OF SIMILAR
ECONOMIC LEVELS IN THE SAME HOUSING MARKET AREA SHOULD HAVE
AVAILABLE TO THEM A LIKE RANGE OF HOUSING CHOICES REGARDLESS OF
THEIR RACE, COLOR, RELIGION, SEX, NATIONAL ORIGIN, OR HANDICAP.
To inform the public about the City's affirmative action
policy the City will cause the foregoing statement to be
published at least once annually in the Arkansas Democrat - Gazette
and the Arkansas State Press. The Equal Housing Opportunity
logotype or slogan will be included in all press releases and
informational materials for the public.
To inform owners the policy statement will be bound in
application packets, and owners will be informed of the City's
policy on affirmative action in any advertisements or promotional
materials. As record- keeping requirements and compliance with
fair housing laws will be part of all assistance agreements with

owners, the City's policy will be discussed with owners as part 250
of the application process.
To inform potential tenants and homebuyers the City will
include the policy statement in application packets and will
print the Equal Housing Opportunity slogan or logotype on forms
and instructions. In addition the City will make available in
the HOME administration reception area literature on Fair Housing
laws and the rights of minorities and women to equal housing
opportunity.
Every owner and agency entering into an agreement with the
City to fund a project wholly or in part with HOME money must
agree to abide by applicable fair housing and equal opportunity
laws and regulations, to use a newspaper of general circulation
to advertise vacancies or properties available for purchase, to
use the Equal Housing Opportunity slogan in advertisements and
written announcements, to maintain records on the racial and
gender identities of applicants and tenants, and to report such
data annually to the City on request.
Every CHDO or subrecipient participating in the HOME program
and every owner of a project comprised of five or more units to
be assisted under the program must develop an Affirmative
Marketing Plan acceptable to the City's Housing Programs Division
as meeting requirements of the City and of Federal regulations
for the HOME program. This plan is to be incorporated into a
legally binding agreement with the City. The Affirmative
Marketing Plan must be directed toward obtaining applications

from persons of the racial group least likely to apply to buy or
lease the assisted property and must provide at least the 25
following:
1. A written determination of the racial group from which
applicants are least likely to come and to which special
outreach is to be directed.
2. Whenever more than 50 percent of current tenants of a
project are of a minority group or the census block
group in which the project is located is more than 51%
minority, the owner will
a. Use newspapers and other media of general
circulation or orientation to advertise units or
properties available; and,
b. Specify at least two social service agencies which
serve both white and non -white clients or religious
institutions with majority members to which the
owner will send letters informing them approximately
when the housing will be available and of the
intention to lease or sell on the same terms to both
majority and minority applicants. Among such
agencies are: Family Service Agency of Central
Arkansas, St. Francis House, Inc., Catholic Social
Services, Presbyterian Urban Council, Arkansas
Conference of Churches and Synagogues, and various
churches.

3. Whenever less than 30 percent of the current residents
of the project site are of the minority or the immediate
vicinity of the site is predominantly populated by
persons of the racial majority, the owner will use the
Arkansas State Press as well as newspapers of general
circulation to advertise availability of assisted units.
(Other measures may be taken, of course, such as
notification of churches with a predominantly minority
membership.)
4. The owner will display the Equal Opportunity logo and /or
slogan in all advertising and communications concerning
HOME funded projects.
The City's Housing Programs Division will collect and keep
records of the racial and gender identities of all applicants for
assistance, whether successful or unsuccessful, who apply
directly to the City. It will require subrecipients, owners,
agents, and others through whom HOME assistance may be provided
indirectly to keep similar records. The City will keep and will
require subrecipients, owners, and other agents to keep copies of
advertisements, press releases, letters to fair housing groups
and social service agencies, promotional materials, and other
documents to demonstrate good faith effort toward affirmative
marketing.
The City's Housing Programs Administrator will be
responsible for an annual assessment of affirmative marketing
efforts of the City and of all individuals and agencies which the
City has required to implement an affirmative marketing plan as

part of an agreement for HOME program assistance. Results will '� 3
be tabulated to show total participation, minority participation,
female- headed household participation, and participation by
persons with disabilities in each project assisted with HOME
funds. In addition, a check -form will list all of the actions
required as described herein and the records will be examined to
determine whether the required actions have or have not been
taken in each instance. Where a required action has not been
taken or there is no record to document it, the individual or
agency will be given 30 days to evidence corrective action and
will be required for a period of one year to notify the City when
an affirmative action step is taken, such as placement of a
vacancy advertisement or the writing of a letter of notice to a
fair housing agency. Should no timely corrective actions be
taken, the City will disqualify the individual or agency for
further participation in the HOME program.
A report on the annual assessment of affirmative marketing
efforts in the HOME program will be submitted to the City Manager
and a copy will be kept on file.

OUTREACH TO MINORITY AND WOMEN -OWNED BUSINESSES 254
It is the policy of the City of Little Rock to encourage and
utilize minority and women -owned businesses (MBE's /WBE's) to the
fullest extent possible. The City will continue that endeavor in
the HOME Investment Partnerships Program and will utilize that
program's special features to develop more effective affirmative
actions. Steps to be taken include but are not limited to the
following:
1. The City will publish at least annually in the Arkansas
Democrat - Gazette and the Arkansas State Press (a
minority - oriented weekly) a statement of Little Rock's
equal opportunity and affirmative action policy as it
pertains to housing programs in general and to the HOME
program in particular. (See following section on
affirmative marketing.)
2. The City will develop, maintain, and update regularly
lists of MBE /WBE general contractors. The City will
also develop and maintain lists of MBE /WBE specialty
contractors, such as plumbers, electricians, landscape
gardeners, and roofers. The City will develop and
maintain lists of MBE /WBE firms which supply goods and
services related to housing development and
construction, including but not limited real estate
agencies, legal counsel, appraisal, financial services,
investment banking, insurance and bonds, building
materials, office supplies, and printing. These lists
will be supplied to CHDOs, CDCs, contractors, and owners

who are applying for assistance under the HOME
Investment Partnership program or who enter into
contracts or agreements with the city for HOME - assisted
projects.
3. The CDBG and Housing Programs Division will conduct at
least one workshop during each year to explain the
City's entitlement grant programs and brief MBEs and
WBEs on changes and new developments.
4. The City will require MBE /WBE outreach plans in all
written agreements with CHDOs and owners or sponsors of
projects other than owner- occupied rehabilitations
administered by the City under technical assistance
requests.
5. The City will routinely notify MBE /WBE contractors and
suppliers by direct mail of all awards or agreements for
multi -unit housing projects, including in the notice the
nature of the activity or activities, estimated project
costs, the number of units to be developed, and the name
and address of the owner, manager, or sponsor.
6. The City's Housing Programs Administrator will have the
responsibility to maintain records and make annual
reports to the City Manager by way of the Director of
Neighborhoods and Planning on MBE /WBE outreach in the
City's Housing Programs. The report will include at
least the following:
(1) A narrative on MBE /WBE outreach actions taken
during the year

(2) Statistics on total participation and MBE /WBE
contractor and subcontractor participation in the
City's various housing assistance programs during
the reporting period
(3) The current lists of MBE /WBE contractors and
suppliers
(4) Plans and recommended changes in the MBE /WBE
outreach effort.

CERTIFICATIONS
HOME PROGRAM DESCRIPTION
In accordance with the HOME Investment Partnerships Act and
with 24 CFR 92.150 of the HOME Investment Partnership Program
Rule, the participating jurisdiction certifies that:
(a) Before committing any funds to a project, it will evaluate
the project in accordance with the guidelines that it adopts
for this purpose and will not invest any more HOME funds in
combination with other Federal assistance than is necessary
to provide affordable housing;
(b) If the participating jurisdiction intends to provide tenant -
based rental assistance;
The use of HOME funds for tenant -based rental assistance is
an essential element of the participating jurisdiction's
annual approved housing strategy for expanding the supply,
affordability, and availability of decent, safe, sanitary,
and affordable housing.
(c) The submission of the program description is authorized
under State and local law (as applicable), and that it
possesses the legal authority to carry out the HOME
Investment Partnerships (HOME) Program, in accordance with
the HOME regulations;
(d) It will comply with the acquisition and relocation
requirements of the Uniform Relocation Assistance and Real
Property Acquisition Policies Act of 1970, as amended,
implementing regulations at 49 CFR Part 24 and the
requirements of 24 CFR 92.353;
(e) It and State recipients, if applicable, will use HOME funds
pursuant to its Comprehensive Housing Affordability Strategy
(CHAS) approved by HUD and all requirements of 24 CFR Part
92;
(f) It will or will continue to provide a drug -free workplace
by:
1. Publishing a statement notifying employees that the
unlawful manufacture, distribution, dispensing,
possession, or use of a controlled substance is
prohibited in the grantee's workplace and specifying
the actions that will be taken against employees for
violation of such prohibition;
2. Establishing an ongoing drug -free awareness program to
inform employees about -

The dangers of drug abuse in the workplace;

maintaining a drug -free workplace;

Any available drug counseling, rehabilitation, and
employee assistance programs and
(d) The penalties that may be imposed upon employees
for drug abuse violations occurring in the
workplace;
Making it a requirement that each employee to be
engaged in the performance of the grant be given a copy
of the statement required by paragraph (1);
Notifying the employee in the statement required by
paragraph (1) that, as a condition of employment under
the grant, the employee will --
(a) Abide by the terms of the statement; and

(b) Notify the employee in writing of his or her
conviction for a violation of a criminal drug
statute occurring in the workplace no later than
five calendar days after such conviction;
5. Notifying the agency in writing, within ten calendar
days after receiving notice under paragraph 4(b) from
an employee or otherwise receiving actual notice of
such conviction. Employers of convicted employees must
provide notice, including position title, to every
grant officer or other designee on whose grant activity
the convicted employee was working, unless the Federal
agency has designated a central point for the receipt
of such notices. Notice shall include the
identification number(s) of each affected grant;
6. Taking one of the following actions, within 30 calendar
days of receiving notice under paragraph 4(b), with
respect to any employee who is so convicted --
(a) Taking appropriate personnel action against such
an employee, up to and including termination,
consistent with the requirements of the
Rehabilitation Act of 1973, as amended; or
(b) Requiring such employee to participate
satisfactorily in a drug abuse assistance or
rehabilitation program approved for such purposes
by a Federal, State, or local health, law
enforcement, or other appropriate agency;

Making a good faith effort to continue to maintain a
drug -free workplace through implementation of 25c,
paragraphs, 1, 2, 3, 4, 5 and 6.
The grantee may insert in the space provided below the
site(s) for the performance of work done in connection
with the specific grant:

(g) To the best of its knowledge and belief:
1. No Federal appropriated funds have been paid or will be
paid, by or on behalf of it, to any person for
influencing or attempting to influence an officer or
employee of any agency, a Member of Congress in
connection with the awarding of any Federal loan, the
entering into of any cooperative agreement, and the
extension, continuation, renewal, amendment, or
modification of any Federal contract, grant, loan, or
cooperative agreement;
2. If any funds other than Federal appropriated funds have
been paid or will be paid to any person for influencing
or attempting to influence an officer or employee of
any agency, a Member of Congress, an officer or
employee of Congress, or any employee of a Member of
Congress in connection with this Federal contract,
grant, loan, or cooperative agreement, it will complete
and submit Standard Form -LLL, "Disclosure Form to
Report Lobbying," in accordance with its instructions;
and
3. It will require that the language of paragraph (g) of
this certification be included in the award documents
for all subawards at all tiers (including subcontracts,
subgrants, and contracts under grants, loans, and
cooperative agreements) and that all subrecipients
shall certify and disclose accordingly.
(h) The participating jurisdiction agrees to assist HUD to
comply with 24 CFR part 50 and shall:
1. Supply HUD with all available, relevant information
necessary for HUD to perform for each property any
environmental review required by part 50;
2. Carry out mitigating measures required by HUD or select
alternate eligible property; and

3. Not acquire, rehabilitate, convert, lease, repair or
construct property, or commit HUD or local funds to
such program activities with respect to any eligible
property, until HUD approval is received.
