INTERLOCAL AGREEMENT WITH PULASKI COUNTY,
ARKANSAS TO PROVIDE AN ADDITIONAL PUBLIC
DEFENDER FOR THE LITTLE ROCK MUNICIPAL
COURT; AND FOR OTHER PURPOSES.

WHEREAS, the Board of Directors stated in Little Rock,
Ark., Res. No. 9,085 (January 18, 1994), an intention to enter
into an interlocal agreement with Pulaski County to provide
funding for an additional public defender to serve the Little
Rock Municipal Court; and
WHEREAS, the terms of this agreement have now been worked
out between the City and the County.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The Mayor and City Clerk are authorized to
execute an interlocal agreement with Pulaski County, in
substantially the form attached as Exhibit 1 to this resolution,
for the purpose of providing an additional public defender for
the Little Rock Municipal Court.

INTERLOCAL COOPERATION AGREEMENT BETWEEN
THE CITY OF LITTLE ROCK AND PULASKI COUNTY, ARKANSAS,
TO PROVIDE FOR AN ADDITIONAL PUBLIC DEFENDER
TO SERVE THE LITTLE ROCK MUNICIPAL COURT.
The City of Little Rock, Arkansas, and the Quorum
Court of Pulaski County, Arkansas, pursuant to appropriate
resolutions and ordinances adopted by their respective
governing bodies, enter into this Interlocal Cooperation
Agreement pursuant to the authority provided in Ark. Code
Ann. §$ 25 -20 -101 to -108 (Michie 1987) this ^ day of
, 1994.
1. Duration. This agreement shall be in full force
and effect from and after the date of its adoption, and
approval by the Attorney General, until December 31, 1994,
provided that it will continue in duration if prior to
December 31 of any year, the Board of Directors of the City
of Little Rock ("City"), and the Quorum Court of Pulaski
County ( "County"), adopt a resolution expressing an intent
to continue to agreement for an additional year and to
provide any funding necessary to fulfill the terms of the
agreement.
2. Purpose. The purpose of this agreement is to
assure that an additional public defender will be provided
by Pulaski County for service in the Little Rock Municipal
Court ( "Court "). It is the belief of the City and County
that the Court will need the service of an additional
public defender to provide constitutionally guaranteed
protections of the right to counsel to persons appearing in
one of the three divisions of the Court.

3. Financing. The cost of employing this additional
public defender will be paid by the City to the County
General Fund from the general operating revenues of the
City. However, the public defender will at all times be an
employee of the County and will in no way be subject to any
personnel policies or practices of the City.
4. Termination. During any budget year, this
agreement may be terminated by either party upon ninety
(90) days written notice of an intent to do so to be sent
to the address and individual designated below as the
contact person for the respective parties. In addition,
this agreement shall be terminated upon the failure of
either party to adopt a resolution of intention to continue
the agreement for another year, or upon the failure of
either party to provide the necessary appropriation to
accomplish the purpose of this agreement. Further, while
the public defender to be hired as a result of this
agreement remains a County employee, should the County for
any reason reduce the number of public defenders assigned
to the Little Rock Municipal Court, this agreement shall
terminate automatically on the date of such reassignment
and the City shall be under no obligation for any
appropriation or payment to the County from and after the
date of such reassignment.
