9073• RESOLUTION NO. 9,07 �-i a 1 A RESOLUTION TO ESTABLISH A POLICY THAT 2 REQUIRES RESIDENCY AND DOMICILE WITHIN ry 3 THE CORPORATE LIMITS OF THE CITY OF J 4 LITTLE ROCK, ARKANSAS, IN ORDER TO `d 5 RECEIVE A POSITION OF EMPLOYMENT; n ,1 6 DIRECTING THE CITY MANAGER AS CHIEF PERSONNEL OFFICER FOR THE CITY TO 7 IMPLEMENT THIS POLICY; AND FOR OTHER 8 PURPOSES. 9 10 WHEREAS, the City of Little Rock, Arkansas, is the capital 11 city of the State of Arkansas, the largest city in the State of 12 Arkansas, and the employer of more than 1600 persons; and 13 WHEREAS, the Board of Directors believes that a policy that 14 requires as a condition of employment that persons to be 15 employed must reside and be domiciled within the City of Little 16 Rock; and WHEREAS, the Board of Directors believes that such a policy 17 will promote a greater sense of community involvement, will 18 enhance the impact of city salary payments upon the local tax 19 base, and otherwise make for a more cohesive and constructive 20 environment; and WHEREAS, the Board of Directors recognizes that more than 21 75% of its $71 million dollar budget goes for salary, pension, 22 and employee benefit payments. 23 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF 24 THE CITY OF LITTLE ROCK, ARKANSAS: 25 SECTION 1. Beginning January 1, 1994, it is the policy of the City of Little Rock, Arkansas, to require as a condition of 26 employment that a person employed by the City or accepting a 27 position with the City reside and be domiciled within the 28 corporate limits of the City of Little Rock, Arkansas. 29 SECTION 2. All persons employed by the City after January 30 1, 1994, or that are tendered an initial offer of employment after that date, must come into compliance with the provisions 31 of Section 1 of this resolution. Failure to comply with the 32 City's residency policy as set forth in this resolution shall be 33 grounds for termination for cause. 34 SECTION 3. SECTION 4. The City Manager is provided authority to recognize special circumstances that make the immediate application of the policy set forth above inappropriate, Provided that except in the case of an act of God or other emergency any such recognition shall not extend for a period of 30 days after the acceptance of employment contemplated in Section 1. For purposes of illustration, this Section means that the City Manager may grant a 90 -day period of grace to a new employee to allow that employee to move to a residence and domicile within the corporate limits of the City, provided that if the employee fails to do so, the employee shall be terminated for cause. For purposes of illustration of an Act of God or other emergency, the City Manager is authorized to adopt a policy to deal with city employees whose homes are destroyed by accident or natural disaster who have to move in with relatives on a temporary basis, provided that failure to return to residence and domicile within the City limits within a reasonable time shall be the basis for termination for cause.
