8998� , � M M M 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 441 RESOLUTION NO. 8,998 A RESOLUTION OF SUPPORT FOR EFFORTS TO RELOCATE A MEDICAL WASTE INCINERATOR ON DIXON ROAD TO AN AREA THAT WOULD OTHERWISE COMPLY WITH THE CITY'S MEDICAL WASTE FACILITY SITING ORDINANCE; DIRECTING THE CITY ATTORNEY TO COOPERATE WITH EFFORTS TO OPPOSE THE LOCATION OF THIS FACILITY; AND FOR OTHER PURPOSE. WHEREAS, the City has carefully considered the issue of whether medical waste incinerators should be located in close proximity to occupied structures within the City; and WHEREAS, the City has adopted an ordinance, consistent with recently promulgated state law, that sets siting requirements a minimum distance from such structures; and WHEREAS, a medical waste facility is currently proposed for Dixon Road which is close to three public schools in the area; and WHEREAS, the City cannot enforce its extraterritorial zoning and siting jurisdiction at this time since a plan for this area has not been developed; and WHEREAS, the City Attorney has gained some expertise in this area by working on this ordinance. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The Board of Directors of the City of Little Rock goes on record as opposing the present siting of a medical waste incinerator on Dixon Road and formally opposes any location of such a facility that does not meet the spirit or letter of the medical waste facilities ordinance. SECTION 2. The City Attorney is directed to take whatever actions possible, including but not limited to intervention into any litigation or the preparation of amicus briefs on any appeal, to make the views of the Board of Directors known.
