M M M 8,782 • 5l'7 1 2 3 A RESOLUTION CALLING AN ELECTION TO 4 CERTIFY THAT THE BOARD OF DIRECTORS MAY, PURSUANT TO ARKANSAS STATUTES AND 5 AMENDMENT 59 OF TBE ARKANSAS 6 CONSTITUTION, SET A MILLAGE RATE OF UP 7 TO ONE HILL FOR THE BENEFIT OF THE 8 LITTLE ROCK, ARKANSAS, POLICE PENSION 9 RELIEF FUND; SETTING A DATE; AND FOR OTHER PURPOSES. 10 11 WHEREAS, the citizens approved Initiated Ordinance No. 6175 12 by majority vote held April 1, 1941; and 13 WHEREAS, this ordinance established that the City could levy up to one mill on personal and real property assessments for 14 the purpose of funding a police pension and relief fund for the 15 benefit of retired policemen, widows and the minor children of 16 deceased policemen; and 17 WHEREAS, the actual millage levied on any annual basis is 18 to be determined by the City Board of Directors upon a report by the Board of Trustees of the Little Rock, Arkansas, Police Pension 19 & Relief Fund, as to the amount of money that "will be required to 20 pay pensions to retired policemen, and pension to widows and minor 21 children of deceased policemen and widows and minor children of 22 deceased retired policemen, for the following year;" and 23 WHEREAS, the annual levy has been limited to six - tenths (.6) of a mill by operation of Amendment 59; and 24 WHEREAS, Pulaski County has equalized its personal and real 25 property tax assessments and, therefore, can now raise its 26 personal property tax assessments; and 27 WHEREAS, there is a question as to whether this can be done 28 by Board action alone, or whether it requires a separate election; and 29 WHEREAS, the Board of Trustees of the Little Rock, 30 Arkansas, Police Pension and Relief Fund has asked this Board to 31 call an election. 32 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF 33 THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1: An election shall be held during the general 34 election on November 3, 1992, at which time the following question 35 will be submitted to the electorate: 36 M x_57 D -1 M M 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 FOR restoring to the Board of Directors of the City of Little Rock the authority to again levy up to one full mill for the Police Pension Fund on real and personal property within the City now that property assessments with Pulaski County have equalized under the rollback provisions of Amendment 59 ............ ...............................
