A RESOLUTION AUTHORIZING THE MAYOR
AND CITY CLERIC TO EXECUTE AN
ASSIGNMENT OF THE CITY'S RIGHT TO
REACQUIRE RIGHT -OF -WAY.
WHEREAS, right -of -way for the Interstate 630 construction
project was acquired by the City and subsequently conveyed to
the Arkansas State Highway Commission; and
WHEREAS, Arkansas state law requires the Highway Department
to offer surplus right -of -way which is no longer necessary or
desirable for state highway purposes to the former owner before
it can be sold to the public; and
WHEREAS, the City has received a request to relinquish its
right to reacquire a small parcel located on the North side of
I -630 at Booker Street; and
WHEREAS, the City does not desire to reacquire said parcel.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The Mayor and City Clerk are authorized to
execute an assignment of the City's right under Ark. Code Ann. §
27 -67 -322 to reacquire that part of the real property sold to
the Arkansas State Highway Commission in Pulaski County,
Arkansas, described as Job 6767, Tract 173, legally described in
the exhibit attached hereto, to Michael D. Vano.
