ORDINANCE NO. 11 s 366
AN ORDINANCE LEVYING A PRIVILEGE TAX TO BE PAID BY THE
ARKANSAS LOUISIANA GAS COMPANY FOR THE CALENDAR YEAR 1963
AND FUTURE YEARS; PROVIDING FOR THE PAYMENT THEREOF; DE-
CLARING AN EMERGENCY; AND FOR OTHER PURPOSES.
�'LHEREAS, the City of Little Rock desires to enact and impose
upon the Arkansas Louisiana Gas Company a tax which shall be in lieu
of all other, licenses, charges, fees or special taxes, other than the
usual general, or special ad valorem taxes, for the privilege of doing
business in the City of Little Rock; and
WHEREAS, the City recognizes an Order of the Arkansas Public
Service Commission relating to and approving a formiila for the computa-
tion of municipal taxes being computed by multiplying the average num-
bcr of meters in operation by the rate of Two and No/100 Dollars ($2.00)
per meter per year;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF

SECTION 1. There is hereby levied against the Arkansas Louisian4
(�j S GOTn1-) anv an annual franchise or privilege tax to be paid to the City
oll.- Little Rock for the privilege of doing business in the City of Little
Rock, Arkansas, for the calendar year 1963 and future years until changed
by ordinance an amount determined by multiplying the average number of
in operation within the corporate limits of the City for the pre-
ceding calendar year by the sum of Two and No/100 Dollars ($2.00) per

SECTION 2. The sum charged per meter and thus the total amount
to be paid by the Arkansas Louisiana Gas Company may be changed at any
time by the Board of Directors of the City of Little Rock by the passage
of an ordinance and upon sixty (60) days written notice thereof to the

SECTION 3. The Arkansas Louisiana Gas Company, beginning
on or before 'March 1, 1,963, and each succeeding, 1.11arch I-st thr.!reafter,
s'hall furnish, and provide the City with a certified report reflecting
the average number of domestic and commercial meters in service with-
in the corporate limits of the City as of December 31st of the last
preceding calendar year.
SECTION 4. The annual payment herein required shall be in
lieu of all other licenses, charges, fees or impositions, other than
the usual general or special ad valorem taxes, which may be -imposed
by the City under authority conferred by law.
SECTION S. Nothing herein shall be construed to alter or
cll-mange the, terms or conditions of the present franchise under which
the Gas Company is operating in any way excepting as to the matter of
Lhe ffrancl-iise or privilege tax herein provided.
SECTION 6. Whereas there is a great need for revenues in the

City of Little Rock to carry on necessary public service; and, whereas
the Arkansas Public Service Commission has approved a standard formula
for computation for municipal Occupation (license, Franchise, or other
special city) Taxes which formula is adopted by this ordinance; and,
v he -reas this ordinance should become effective immediately in order to
provide for the prompt computation and collection of said taxer, there-

Lore, an emergency is hereby declared to exist and this ordinance being
necessary for the i,.�,,mediate protection of the public peace, health and
safety shall take effect ir=ediately upon its passage and app�_ovaj. This
ordinance shall continue in effect and be in force until terminated by
City or the Arkansas Louisiana Gas Company as of the end of any calendar

year after giving one year's notice of intention to terminate.
