3 AN ORDINANCE TO ABANDON A PORTION OF AN
4 UNIMPROVED 20 -FOOT ALLEY LOCATED WITHIN BLOCK 1,
5 BELLEVUE ADDITION, INCLUDING THE UTILITY AND
6 DRAINAGE EASEMENTS, AS A PUBLIC RIGHT -OF -WAY; AND
7 FOR OTHER PURPOSES.

9 WHEREAS, a request was made to abandon a portion of an unimproved 20 -foot
10 alley located within Block 1, Bellevue Addition, including the utility and drainage
11 easements, pursuant to the City's general police power authority under Ark. Code Ann.
12 § 14 -54 -104;
13 WHEREAS, the Board has determined that the abandoning of this public right -
14 of -way will not have an adverse impact on the adjacent property owners nor the local
15 traffic, and therefore, the right -of -way abandoned by this ordinance is no longer needed
16 for corporate purposes.
17 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
18 OF THE CITY OF LITTLE ROCK, ARKANSAS:
19 Section 1. The Board of Directors hereby releases, vacates, and abandons a
20 portion of an unimproved 20 -foot alley located within Block 1, Bellevue Addition,
21 including the abandonment of utility and drainage easements.
22 Section 2. A copy of this ordinance duly certified by the City Clerk, shall be
23 filed in the real estate records of the recorder of the Circuit Clerk in ex officio recorder
24 of Pulaski County, Arkansas.
25 Section 3. Severability. In the event any title, section, paragraph, item,
26 sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid

or unconstitutional, such declaration or adjudication shall not affect the remaining
portions of the ordinance which shall remain in full force and effect as if the portion so
declared or adjudged to be invalid or unconstitutional was not originally a part of the
ordinance.
Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same
that are inconsistent with the provisions of this ordinance are hereby repealed to the
extent of such inconsistency.
