2 A RESOLUTION TO AUTHORIZE THE MAYOR AND THE CITY CLERK TO EXECUTE A
3 QUITCLAIM DEED NEEDED TO CLEAR UP THE TITLE AND CONVEY CERTAIN PROP -
4 ERTY, LESS AND EXCEPT THE RIGHT -OF -WAY, LOCATED ALONG "N" STREET IN
5 THE CITY OF LITTLE ROCK, ARKANSAS TO WILLIAM WHISNANT; AND FOR OTHER
6 PURPOSES.

8 WHEREAS, In 1999, the City acquired certain right -of -way from Daniel and Carolyn Cashman
9 that fronted on "N" Street, more particularly described as right -of -way located on Lot 17, Block 10 Rif -
10 fel Et Rhoten's Forest Park Highlands Addition, and
1 1 WHEREAS, subsequently in 2006 the Cashmans deeded the lot to Heifer International Founda-
12 tion and Heifer then deeded the lot to William Whisnant, and,
13 WHEREAS, it has come to the City's attention that the legal description that was included as
14 part of the initial 1999 deed to the City contained a confusing and possibly incorrect legal description
15 and this problem needs to be corrected.
16 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
17 ROCK, ARKANSAS:
18 Section 1. To property effect the agreement about the exchange of property between the City
19 of Little Rock and the Cashmans, the Mayor and City Clerk are hereby authorized to execute a Quit -
20 claim Deed of the property, less and except the right -of -way, to William Whisnant, in order to clear up
21 any confusion and remove any clouds on the title, and any other necessary documents to convey, in a
22 form approved by the City Attorney, the property described in Attachment A attached hereto, to Wit -
23 Liam Whisnant.
24 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause,
25 phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such decla-
26 ration or adjudication shall not affect the remaining portions of the resolution which shall remain in
27 full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not
28 originally a part of the resolution.
29 Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are incon-
30 sistent with the provisions of this resolution, are hereby repeated to the extent of such inconsistency.

QUITCLAIM DEED
KNOW ALL MEN BY THESE PRESENTS:
That the CITY OF LITTLE ROCK, Grantor, duly authorized by resolution of its Board of
Directors on Decm ber 5 2006 for and in consideration of Ten Dollars ($10.00), and other
valuable consideration, receipt of which is hereby acknowledged, does hereby grant, convey and
quitclaim unto WILLIAM W. WHISNANT, AN UNMARRIED PERSON, Grantee, all of
Grantor's right, title, interest, equity and claim in and to the following described lands lying in the
County of Pulaski and State of Arkansas, to -wit:
Lot 17, Block 10, of the Riffel & Rhoten's Forest Park Highlands Addition to
the City of Little Rock, Pulaski County, Arkansas, LESS AND EXCEPT:
Beginning at the Southwest Property Corner, thence North 5.0 feet along the
West property line, thence East 50 feet, thence South 5.0 feet along the East
property line, thence West 50 feet along the existing north right of way of "N"
Street to the point of beginning.
TO HAVE AND TO HOLD the same unto the said Grantee and unto his successors and
assigns forever, with all appurtenances thereunto belonging.
IN WITNESS WHEREOF, the Grantor has caused this Quitclaim Deed to be signed in its
name and behalf by the Mayor and its corporate seal to be hereunto affixed and attested by the City
